CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2004 - 7 <br />BY: Mayor Musial <br />AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF NORTH <br />OLMSTED TO ENTER INTO A NEW, TWO YEAR SERVICES <br />AGREEMENT WITH BOB'S ICE CREAM, INC. DBA QUALITY QUICK <br />SNAC%S FOR VENDING AND VIDEO GAME MACHINES AT THE <br />NORTH OLMSTED RECREATION CENTER AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, pursuant to Chapter 111 of the North Olmsted codified ordinances, <br />the Recreation Commissioner established and filed specifications for offers of proposals <br />for full service vending and video game machines to be maintained at the North Olmsted <br />Recreation Center; and, <br />WHEREAS, pursuant to said Chapter 111 and the procedures therein, offers of <br />proposals were received and reviewed by the Recreation Commissioner and then <br />submitted to the Board of Control, resulting in its approval and recommendation of the <br />proposal by Quality Quick Snacks; and <br />WHEREAS, it is the desire of this Council to authorize a new, two-year, full- <br />services vending contract with Quality Quick Snacks; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized to enter into an <br />Agreement with Bob's Ice Cream, Inc., d.b.a. Quality Quick Snacks for Vending and <br />Video Game Machines at the North Olmsted Recreation Center, commencing in 2004 <br />and terminating in 2006, in substantially the form and substance as evidenced in Exhibit <br />A attached to this Ordinance. <br />SECTION 2: That this Council finds that sufficient funds for the payment of all <br />monies due to Quality Quick Snacks under the terms of this vending services Agreement <br />will be generated by and limited by its proportionate share of revenues derived therefrom. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and <br />for the reason that the existing, outdated equipment needs to be replaced as soon as <br />possible and so that revenues may generated and increased as a result of this Agreement, <br />and further provided it receives the affirmative vote of two-thirds of all members of <br />Council, it shall take effect and be in force immediately upon its passage and approval by <br />the Mayor. <br />.. ... . ... ?.__ . .,,...,i,..a-o-a+=uRw-i%5 a N?+nm..-F....,. z e....,. ...... ...... . .. ? .n-x .. ?
