DATE North Olmsted 20nr.-73 Cuyahoga County, Ohio, in the matter of the hereinafter described 'unprovement and to request cooperation by the Director of Transportation. WHEREAS, the City has identified the need for and proposes the improvement of a portion of the public highway which is described as follows: To provide for a single agency to own and maintain the traffic signal.system along Stearns Road, including the ODOT ramp signal at the interchange of I-480 WB and Stearns Road. This would give the City of North Oimsted control of the entire signal system which would enhance the ixnplementation of any futttre timing changes and response time for service calls. This ownership and maintenance transfer will be for the existing operation and the future upgrading of Stearns Road and the signal system. said portion of the highway within the municipal corporation limits being hereinafter referred to as the unprovement, and WHEREAS, the city further desires cooperation from the Director of Transportarion in the planning, design and construction of said improvement. NOW THEREFORE, Be it ordained by the Council of the City of North Olmsted ,Ohio: SECTION I (Cooperation) That said City hereby request the cooperation of the Director of T'ransportation in the cost of the above described improvement as follows: The city has requested that the ownership and complete maintenance, including labor, equipment, materials, energy cost, and as further described in Section V herein, of the ramp signal at the interchange of I-480 WB and Stearns Road be transferred from the Ohio Department of Transportation (ODOT) to the City of North Olmsted. At any tune in the future if ODOT determines that the operation of the above subject signal hinders the flow of traffic on the Interstate facility, the City of North Olmsted agrees to implement mitigating measures to the satisfaction of the Director in accordance with the attached procedural statement to alleviate the operational deficiency. SECTION II (Consent) That it is declared to be in the public interest that the consent of said City be and such consent is hereby given to the D'uector of Transportation to construct the above described improvement, in accordance with plans, specifications and estimates as approved by the Director. . SECTION III (Authority to Sign) That the Mayor of said City, is hereby empowered and directed on behalf of the City to enter into agreements with the Director of Transportation necessary to complete the planing and construction of this improvement. SECTION IV (Traffic Control Signals and Devices) That traffic contcol devices installed within the limits of the project will conform with Section 4511 of the Ohio revised Code. Page 1 of 3 ,.
