CITY OF NORTH OLMST'ED <br />RESOLUTION NO. 2004 - 75 <br />By: Mayor Musial <br />A RESOL UTION A UTHORIZING THE DIRECTOR OF PUBLIC SERVICE <br />TO PURCHASE A NEW 250 XP BANDIT CHIPPER THROUGH THE <br />STATE PURCHASE PROGRAM AND TO TRADE-IN OLD CHIPPER <br />EQUIPMENT; FURTHER AUTHORIZING THE MAYOR TO EXECUTE A <br />PURCHASE AGREEMENT WITH FRAN%LIN TRACTOR SALES, INC. IN <br />THE AMOUNT OF $22, 711. 00; AND DECLARING AN EMERGENCY. <br />WHEREAS, the North Olmsted Service Department needs to replace one Bandit Chipper <br />equipment and proposes to trade-in the one being replaced; and <br />WHEREAS, the funds necessary for the purchase of this equipment have been addressed <br />by the Director of Finance and have been approved by this Council through appropriation <br />hearings and are therefore available for this purpose; and <br />WHEREAS, this contract is not legally required to be competitively bid or approved by <br />the Board of Control; and <br />WHEREAS, it is the desire of this Council to authorize the Director of Public Service to <br />purchase a new 250 XP Bandit Chipper from, and to trade-in similar equipment to, Franklin <br />Tractor Sales, Inc., through the State purchase program in the amount of $22,711.00, and to <br />further authorize the Mayor to execute necessary purchase agreements; <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Director of Public Service be and he is hereby authorized to <br />purchase through the State Purchasing Program, which was established by O.R.C. Section 125.04 <br />and which the City is authorized to participate in pursuant to Ordinance No. 87-6, one new 250 <br />XP Bandit Chipper and to trade-in one used Chipper, in the amount of $22,711.00. As necessary <br />to effectuate any such purchase through the State Purchasing Program, the Mayor is hereby <br />authorized to execute any contract and/or other appropriate documents required by the authorized <br />vendor(s) or the State of Ohio. Any such contract(s) executed by the Mayor sha11 be in a form <br />and substance consistent with the provisions of this Resolution and approved by the Director of <br />Law. <br />SECTION 2: That the funds necessary for the aforesaid equipment purchase have been <br />addressed by the Director of Finance, made available and have been duly appropriated by this <br />Council. <br />
