CITY OF NORTH OLMSTED ORDINANCE NO. 2004 - 80 BY: Mayor Musial AN ORDINANCE AMENDING SECTION 1363.07 OF CHAPTER 1363 OF THE REAL PROPERTY MAINTENANCE CODE, ENTITLED "D UTIES AND RESPONSIBILITIES OF OWNERS AND OPERATORS" IN ORDER TO UPDATE AND UPGRADE STANDARDS RELATING TO THE EXTERIOR APPEARANCE OF RESIDENTIAL BUILDINGS AND PREMISES IN THE CITY OF NORTH OLMSTED, AND DECLARING AN EMERGENCY, AS AMENDED. WHEREAS, the 1992 Master Plan recommended that the City of North Olmsted expand its Real Property Maintenance Code to cover residential properties, including all main and accessory buildings and structures, as well as yards in the City of North Olmsted; and WHEREAS, this Council, in 1995, adopted Ordinance No. 1995-33, which extended some, but not all, of the commercial real property maintenance standards to residential properties located in the City of North Olmsted; and WHEREAS, an additional nine years have passed since this Council last reviewed Section 1363.07 of the Real Property Maintenance Code, as it applies to residential properties in the City; and WHEREAS, in those intervening years, the City of North Olmsted has become a more mature community, and studies and surveys of the City's residential neighborhood reveal that a number of residential properties are not being kept and maintained in accordance with the appropriate maintenance standards evident elsewhere within the residential neighborhoods of the City; and WHEREAS, this Council finds that a failure to maintain the exterior appearance of residential properties creates nuisance conditions and blight within residential neighborhoods, that have a deleterious effect upon property values and moreover detract from the quality of the living experience in suburban neighborhoods; and WHEREAS, it is accordingly the desire of this Council to amend the City's Real Property Maintenance Code to update and upgrade the exterior appearance standards for residential buildings and premises in the City of North Olmsted in order to protect property values, eliminate nuisance conditions, prevent blight in the residential neighborhoods, and improve the residential living experience for residents of the City of North Olmsted;
