CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2004 - 80 <br />BY: Mayor Musial <br />AN ORDINANCE AMENDING SECTION 1363.07 OF <br />CHAPTER 1363 OF THE REAL PROPERTY MAINTENANCE <br />CODE, ENTITLED "D UTIES AND RESPONSIBILITIES OF <br />OWNERS AND OPERATORS" IN ORDER TO UPDATE AND <br />UPGRADE STANDARDS RELATING TO THE EXTERIOR <br />APPEARANCE OF RESIDENTIAL BUILDINGS AND <br />PREMISES IN THE CITY OF NORTH OLMSTED, AND <br />DECLARING AN EMERGENCY, AS AMENDED. <br />WHEREAS, the 1992 Master Plan recommended that the City of North Olmsted expand <br />its Real Property Maintenance Code to cover residential properties, including all main and <br />accessory buildings and structures, as well as yards in the City of North Olmsted; and <br />WHEREAS, this Council, in 1995, adopted Ordinance No. 1995-33, which extended <br />some, but not all, of the commercial real property maintenance standards to residential properties <br />located in the City of North Olmsted; and <br />WHEREAS, an additional nine years have passed since this Council last reviewed <br />Section 1363.07 of the Real Property Maintenance Code, as it applies to residential properties in <br />the City; and <br />WHEREAS, in those intervening years, the City of North Olmsted has become a more <br />mature community, and studies and surveys of the City's residential neighborhood reveal that a <br />number of residential properties are not being kept and maintained in accordance with the <br />appropriate maintenance standards evident elsewhere within the residential neighborhoods of the <br />City; and <br />WHEREAS, this Council finds that a failure to maintain the exterior appearance of <br />residential properties creates nuisance conditions and blight within residential neighborhoods, that <br />have a deleterious effect upon property values and moreover detract from the quality of the living <br />experience in suburban neighborhoods; and <br />WHEREAS, it is accordingly the desire of this Council to amend the City's Real <br />Property Maintenance Code to update and upgrade the exterior appearance standards for <br />residential buildings and premises in the City of North Olmsted in order to protect property <br />values, eliminate nuisance conditions, prevent blight in the residential neighborhoods, and <br />improve the residential living experience for residents of the City of North Olmsted; <br />
