s <br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2004 - 88 <br />BY: Mayor Musial <br />A RESOLUTION AUTHORIZING THE MAYOR TO ENTER <br />INTO A CONTRACT WITH ABLE CONTRACTING GROUP, <br />INC. TO PROVIDE AND INSTALL A NEW BACKSTOP AT <br />FIELD NUMBER FOUR IN NORTH OLMSTED PARK, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the backstop at Field Number Four in North Olmsted Park is in poor <br />condition and should be, in the interest of safety for players and spectators, replaced; and <br />WHEREAS, the Director of Public Service has solicited quotes from three <br />contractors, and, after reviewing the said quotes, has recommended Able Contracting <br />Group, Inc. for the contract; and <br />WHEREAS, because of the nature of the services being provided and the dollar <br />amount involved, it is not legally necessary that this contract be either competitively bid in <br />accordance with the provisions of the City Charter or subject to the City's formal RFP <br />process; and <br />WhTEREAS, it is the desire of this Council to authorize the Mayor to enter into a <br />contract with Able Contracting Group, Inc. providing for the latter to provide and install a <br />new backstop at Field Number Four in North Olmsted Park for the amount of Eight <br />Thousand Nine Hundred Forty Dollars ($8,940.00); <br />NOW, THEREFORE, BE IT RESOLYED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, CDUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION l: That the Mayor be and he hereby is authorized enter into an <br />contract with Able Contracting Group, Inc. providing for the latter to provide and install a <br />new backstop at Field Number Four in North Olmsted Pa.rk for the amount of Eight <br />Thousand Nine Hundred Forty Dollars ($8,940.00), in the form of proposal attached to <br />this Resolution as Exhibit A, with only such changes to be hereinafter made as are not <br />substantially adverse to the City and which are approved by the Director of Law. The <br />character of any such changes as not being substantially adverse to the City shall be <br />evidenced conclusively by the execution of the agreements by the Mayor and the approval <br />of the agreements by the Director of Law. <br />
