The Agency may conduct on-site monitoring of a service(s) for wluch funds <br />are being reimbursed under this Agreement at a.ny time during the normal working hours of the <br />Contractor with no prior notification necessary, and the Contractor agrees that representatives of'the <br />Agency shall be given fizll access to the premises upon which such service(s) is being provided. <br />7. To the extent authorized by law, the <br />Contractor agrees to allow representatives of the Agency and ODA and its Office of the State Long <br />Tenn Care Oxnbudsman access to a11 prograrrunatic, fiscal, and other records related ta the <br />service(s) for planning, auditing, and monitoring purposes at any time during the normal working <br />hours of the Contractor with no prior notification necessary, except that priar notice of at least 24 <br />hours shall be given where access is sought to the confidential complaint files of the Contractor. <br />The Contractor agrees to keep client inforrnation including but not Iimited to: name, address, <br />telephone number, date of birth, sex, minority status, handicap status, emergency contact person's <br />narne and telephone number, and functional abilities of client relevant to service(s) delivered. <br />The Contractor agrees to document that service(s) were delivered in accord with the ODA <br />taxonomy of services and Agency clarifications to said taxonomy as we11 as the ODA Service <br />Specification.s and Conditions of Participation. The Contractor agrees that said records shall be <br />accessible to the Agency, except for the names of complainants, residents of Iong term eare <br />facilities, and recipients of community-based long term care services, and retained for a period of <br />three yeaxs follovving the period of this agreement. The Office of the State Long Term Care <br />Ornbudsman of ODA shall have access to the complaint files of the Contractor. The Agency agrees <br />that all information contained in said records will be treated in accord with alI applicable legisiation <br />guaranteeing privacy, especially, the Older Americans Act Amendments of 1987. <br />$, Prnhl .ms in Prnviainn of SPrvices?
