CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2002 -197 <br />BY: Council Member McKay <br />AN ORDINANCE AUTHORIZING THE TRANSFER OF ONE (1) <br />ADDITIONAL STORM SEWER EMPLOYEE FROM THE SERVICE <br />DEPARTMENT TO THE WASTE WATER TREATMENT SECTION <br />OF THE PUBLIC WORKS DIVISION, AND FURTHER <br />AUTHORIZING THE PAYMENT OF WAGES FROM THE SEWER <br />REVENUE FUND, AND DECLARING AN EMERGENCY. <br />WHEREAS, pursuant to authority provided in Article XVIII, Section 3 and <br />Article XVIII, Section 4 of the Ohio Constitution, the City owns and operates a sanitary <br />sewer system (the System), which provides sanitary waste-water collection and treatment <br />services for the City and its inhabitants and for certain adjacent areas in the City of <br />Fairview Park and Olmsted Township and the inhabitants of those areas; and <br />WHEREAS, the City has, over the years as documented by Administration <br />reviews and reports, including the May, 1996, report of former City Environmental <br />Engineer Dennis Long, experienced, at times of heavy precipitation, significant inflow <br />and infiltration of storm water into certain sanitary sewer collection facilities of the <br />System, resulting in an overloading of the System and sanitary wastewater backups, <br />bypasses and overflows; and <br />WHEREAS, the former Environmental Engineer found that such inflows and <br />infiltrations from the storm water sewer system into the sanitary sewer system created <br />potential public nuisances threatening the health and safety of the inhabitants of this <br />community, as well as could constitute violations of state and federal environmental <br />laws; and <br />WHEREAS, an organizational review provided to Council in early 2002 indicated <br />that the duties performed by certain bargaining-unit laborers in the Department of Public <br />Service more appropriately fell under the Waste Water Treatment Section of the Division <br />of Public Works, and that the wages and benefits of said employees holding these <br />bazgaining-unit laborer positions should be paid from the Sewer Revenue Fund; and <br />WHEREAS, this Council, also in eaxly 2002, reviewed a May, 1996, report of <br />then City Environmental Engineer Dennis Long, and further consulted with the said <br />
