CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2002 - 175 <br />BY.• Mayor Musial and Council Member Gareau <br />AN ORDINANCE GREATING NELYSECTION 131. 01 OF THE <br />ADMINISTRATIVE CODE, ENT1'TLED "MAYOR'S <br />CONTRACT AUTHORITY" IN 4RDER TO PROVIDE THE <br />MAYOR WITHLIMITED AUTHORITY TO EXECUTE <br />CONTRACTS INVOLVING EXPENDITURES OF TWO <br />THOUS.AND DOLLARS OR LESS WITHOUT EXPRESS <br />COUNCIL A UTHORIZA TION, AND DEGLARING AN <br />EMERGENCYAS AMENDED. <br />N'HEREAS, Article III, Section 5 of the City Charter provides that the Mayor shall <br />execute all contracts to the City is a party; and <br />WHEREAS, Article IV, Section 13 of the City Charter provides the City Council with <br />general authority ta establish City contracting procedure, consistent with other provisions of the <br />Charter; and <br />WHEREAS, it is the desire of this Councfl to authorize the Mayor to execute contracts to <br />which the City is a party involving expenditures of Five Two Thousand Dollars or less, subject to <br />the deternunation of the Director af Finance that funds have been appropriated and are available <br />for such contract expenditure, and further subject to the opinion of the Director of Law that the <br />contract is in proper form and substance; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUIVCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYfiHOGA AND STATE OF OHIO: <br />SECTION ONE: That there is hereby created new Section 131.01 of the Administrative <br />Code entitled, "Mayor's Contract Authority," which sha11 read in its entirety as follows: <br />"131.01 MAYOR' S CONTRACT AUTHORITY. <br />(A) The Mayor may execute any contract to which the City is a party without obtaining <br />authorization of Council if a11 of the following conditions exist: <br />(1) The contract does not involve an expenditure of City funds in excess of Five <br />Two Thousand Dollars; <br />(2) The Director of Finance certifies, if an expenditure of funds is involved, that, <br />pwsuant to R.C. Section 5705.41, sufficient funds have been lawfully appropriated and <br />are available for such expenditure; and <br />
