CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2002 -172 <br />BY: COUNCILMAN GEORGE NASHAR <br />AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF <br />NORTH OLMSTED TO ACCEPT CONVEYANCE OF FEE SIMPLE <br />OF CERTAIN REAL PROPERTY & RECORD SAME, TO THEN <br />ENTER DEED RESTRICTION5 UPON TO RUN WITH THE <br />DEVELOPMENT LAND, AND THEN TO RECONVEY TITLE TO <br />FAIRVIEW OFFICE ASSOCIATES, LLC, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, Fairview Corporate Center is a development proposed by Zaremba <br />Management for Permanent Parcel Numbers 237-23-023, 237-23-025, 237-23-037, 237-23-041 <br />and 237-23-049, owned by and titled in the name of Fairview Office Associates, LLC, located on <br />the north side of Brookpazk Road, east of the intersection on Clague Road, wherein the office <br />development is located in the City of Fairview Park, but most of the parking area and greenspace <br />is located in the City of North Olmsted; and <br />WHEREAS, pursuant to the review and recommendations of the Planning Commission, <br />as noted by its minutes of June 13, 2000 and again on 7une 25, 2002, as such recommendations <br />were later supplemented by the Architectural Review Board at its meeting on 7uly 17, 2002, and <br />as were later received and approved by the Building, Zoning and Development Committee of <br />this Council, that the Fairview Corporate Center development plan be and was approved with <br />numerous conditions, which included the developer's conveyance of certain real property to the <br />City of North Olmsted for the purpose of imposing and enforcing certain Deed Restrictions <br />thereupon and forevermore upon the development area for the benefit of the City; and <br />WHEREAS, it is the desire of this Council to accept conveyance of an interest in fee <br />simple to said Parcel from the Fairview Office Associates, LLC, and thereafter to proceed to <br />record same in accordance with law and, immediately thereafter, to hereby authorize and direct <br />the Mayor and the Director of Law to enter certain Deed Restrictions upon said Parcel and then <br />to reconvey the said Parcel, with Deed Restrictions attached, back to the Fairview Office <br />Associates, LLC, for the purpose of and to accomplish the conditions and restrictions imposed <br />upon the development plan, so long as such conveyance documents contain the Deed Restriction <br />and are substantially in the format as described in Exhibits A and B attached. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />
