y? <br />RETIREMENT SETTLEMENT AGREEMENT <br />THIS AGREEMENT made this,?(S?day of_? 2002 by and between the City <br />of North Olmsted, Ohio, a municipal corporation (hereinafter called the "City") and Edward C. <br />Bak, Chief of Fire of the North Olmsted Fire Department (kereinafter called "Bak") <br />WHEREAS, Bak has been a North Olmsted Fire Fighter with the North Olmsted Fire <br />Department since October 3, 1977, and, since May 3, 1999, has served as Chief of Fire; and <br />WHEREAS, differences have arisen between the City and Bak regarding Bak's <br />employment with the City of North Olmsted; and <br />WHEREAS, it is the desire of Bak and the City that Bak retire from employment with <br />the City of North Olmsted effective no later than October 11, 2002; and <br />WHEREAS, it is further the desire of Bak and the City that Bak immediately be placed <br />on paid administrative leave commencing with the date of June 21, 2002, and concluding with <br />Bak's date of retirement; and <br />WHEREAS, the parties, through negotiations, have arrived at an agreement wherein all <br />issues between the parties are settled and all claims, rights and obligations, not otherwise <br />conferred by ordinance, rule or regulation, are hereby memorialized within; and <br />WHEREAS, as a result of their settlement of the differ. ences between them as herein <br />provided, the City agrees to withdraw the pending diseiplinary charges against Bak;
