<br />public access roadway to the public Park-N-Ride facility, unto said Grantee, the
<br />GREATER CLEVELAND REGIONAL TRANSIT AUTHORIT'Y, forever and in
<br />perpetuity, subject to revocation upon the discontinuance of the described usage, or any
<br />violation of the conditions imposed thereon by and through the terms hereof or as
<br />otherwise provided by law.
<br />It is the intent of this conveyance of easement that neither the filing of this
<br />easement by the Grantor, its acceptance by the Grantee, nor any other circumstances
<br />relating to the use or liability assigned for the easement area or roadway thereon, nor the
<br />identification of such roadway as "NOMBL Lane", shall be construed as a formal
<br />dedication of the premises herein described as a street for public use, nor an amendment
<br />of the City street map.
<br />And the Grantor does for itself, its successors and assigns, covenants with the said
<br />Grantee, and its successors, that at and until the sealing of these presents, it is well seized
<br />of the above-described premises as a good and indefeasible estate in FEE SIlVIPLE and
<br />has a good right to bargain and grant the same in manner and forms as above written, and
<br />that it will WA,RRANT AND DEFEND SAID PREMISES, with the appurtenances
<br />thereunto belonging to the Grantee, its successors and assigns, against a11 lawful claims
<br />and demands whatsoever for the purpose herein described.
<br />In consideration of the mutual covenants herein contained, the Grantor hereby
<br />gives, grants and conveys unto the said Grrantee, GCRTA, the right and easement to enter
<br />upon said premises and to make permanent roadway improvements thereto, that, in the
<br />opinion of the proper authorities of the Crrantor, CITY, and including ODOT, or its
<br />successors or assigns, as such improvement plans have been described and approved for
<br />installation, and as may be deemed necessary at any time, or to do any other thing that
<br />may be necessary or advisable in the judgment of the said authorities of the CITY or
<br />ODOT, their successors or assigns, in order to maintain the roadway, curbs, paved areas
<br />and sidewalks of the Park-N-Ride facility, in accordance with the ordinances, rules and
<br />regulations for the management and protection of said CITY and/or ODOT, now in force
<br />or that may hereafter be adopted.
<br />The Grantor hereby restricts sa.id premises within the limits of the above-
<br />described easement against the construction thereon of any structures, buildings of a
<br />temporary or permanent type, sidewalks, paved areas or other improvements however
<br />described, except as formally approved for the roadway to the Park-N-Ride facilities by
<br />the aforesaid authorities, the CITY and ODOT.
<br />It is agreed that wherever a party is named in this instrument, there shall be
<br />intended and included, in each case, that party, and its successors and/or assigns, limited
<br />to public entities.
<br />IN WITNESS THEREOF, the undersigned have hereunto set their hands to
<br />certify conveyance and acceptance of the foregoing permanent easement agreement at
