CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2002 - 153 ( <br />BY: Mayor Norman T. Musial <br />A RESOLUTION AUTHORIZING THE MAYOR TO REQUEST <br />PROPOSALS FOR DESIGN SERVICES FOR THE BRADLEY ROAD <br />AND COLUMBIA ROAD SIDEWALK PROJECT; FURTHER <br />AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT <br />WITH THE FIRM THAT PROVIDES SUCH SERVICES THAT IS <br />SELECTED IN THE RFP PROCESS, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the City is commencing the design phase for the Bradley Road and <br />Columbia Road Sidewalk Project; and <br />WHEREAS the design of the Bradley Road and Columbia Road Sidewalk Project <br />requires certain Surveying And Engineering Services to complete its design work; and <br />WHEREAS, it is the desire of this Council to authorize the Mayor to request proposals <br />for the Bradley Road and Columbia Road Sidewalk Project, and further to authorize the Mayor, <br />upon approval by the Board of Control, if necessary, to ent:er into an Agreement with the firm <br />selected; <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCII. OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized to request proposals for <br />surveying and engineering services far the design phase of the Bradley Road and Columbia Road <br />Sidewalk Project consistent with the Request for Proposal, attached to this Resolution as Exhibit <br />A. <br />SECTION 2: That the Mayor be and he hereby is authorized, upon approval of the Board <br />of Control, if necessary, to enter into an Agreement with the firm selected in the RFP (Request for <br />Proposal) process in substantially the form as the Agreement attached to this Resolution as <br />Exhibit B, with only such changes to be hereinafter made as are not substantially adverse to the <br />City and which are approved by both the Mayor and the Director of Law. The character of any <br />such changes as not being substantially adverse to the City sha11 be evidenced conclusively by the <br />execution of the Agreement by the Mayor and the approval of the Agreement by the Director of <br />Law. <br />SECTION 3: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public peac;e, health, safety and welfare of this <br />City, for the further reason that this Resolution is required to be immediately effective to enable <br />the City to timely complete its design work for the Bradley Road and Columbia Road Sidewalk <br />Project; and further provided that it receives the affirmative vote of two-thirds of a11 members of <br />Council, it sha11 take effect and be in force immediately upon its passage and approval by the <br />Mayor. <br />
