CITY OF NORTH OLMS7'ED <br />RESOLUTION NO. 2002 - 151 <br />BY: Mayor Norman T. Musial <br />A RESOLUTION AUTHORIZING THE MAYOR TO REQUEST <br />PROPO5ALS FOR DESIGN SERVICES FOR THE LORAIN ROAD <br />REHABILITATION PROJECT; FURTHER AUTHORIZING THE <br />MAYOR TO ENTER INTO AN AGREEMENT WTTH THE FIRM <br />THAT PROVIDES SUCH SERVICES THAT IS SELECTED IN THE <br />RFP PROCESS, AND DECLARING AN EMERGENCY. <br />WHEREAS, the City is commencing the design phase for the Lorain Road Rehabilitation <br />Project; and <br />WHEREAS the design of the Lorain Road Rehabilitation Project requires certain <br />Surveying And Engineering Services to complete its design work; and <br />WHEREAS, the budget for the Lorain Road Rehabilitation Project includes sufficient <br />funds for retaining the services of a surveying and engineering firm required for its design phase <br />work; and <br />WHEREAS, it is the desire of this Council to authorize the Mayor to request proposals <br />for the Lorain Road Rehabilitation Project, and further to authorize the Mayor, upon approval by <br />the Board of Control, if necessary, to enter into an Agreement with the firm seleeted; <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized to request proposals for <br />surveying and engineering services for the design phase of the; Lorain Road Rehabilitation Project <br />consistent with the Request for Proposal, attached to this Resolution as Exhibit A. <br />SECTION 2: That the Mayor be and he hereby is authorized, upon approval of the Board <br />of Control, if necessary, to enter into an Agreement with the firm selected in the RFP (Request for <br />Proposal) process in substantially the form as the Agreement attached to this Resolution as <br />Exhibit B, with only such changes to be hereinafter made as are not substantially adverse to the <br />City and which are approved by both the Mayor and the Director of Law. The character of any <br />such changes as not being substantially adverse to the City sha11 be evidenced conclusively by the <br />execution of the Agreement by the Mayor and the approval of the Agreement by the Director of <br />Law. <br />SECTION 3: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public peace, health, safety and welfare of this <br />City, for the further reason that this Resolution is required to be immediately effective to enabie <br />the City to timely complete its design work for the Lorain Road Rehabilitation Project; and <br />further provided that it receives the affirmative vote of two-thirds of all members of Council, it <br />shall take effect and be in force immediately upon its passage and approval by the Mayor. <br />
