Ordinance No. 2002 -149 <br />Page 2 <br />SECTION 1: That the Director of Public Service be and he is hereby authorized to <br />advertise for bids utilizing both the single supplier method of furnishing and the multiple <br />supplier method of furnishing for the purchase of those items of furniture and furnishings for the <br />New North Olmsted Branch Library tha.t are identified as "Competitive Bid Items, with an <br />estimated total expenditure of $30,561.65, in the Master Worksheet prepared by Spice <br />Costantino Architects and dated July 4, 2003, and further in accordance with the specifications <br />now on file in his office. <br />SECTION 2: That the Mayor, upon approval by the Board of Control and the written <br />concurrence of the Cuyahoga County Public Library, is hereby authorized to enter into a contract <br />or contracts vuith the IQwest and best bidder or bidders to purchase the furniture and furnishings <br />referred to in Section 1 above from either a single supplier or from multiple suppliers. The <br />contract or contracts shall be in a form and substance consistent with the provisions of this <br />Ordinance and approved by the Mayor and Director of Law. <br />SECTION 3: That the Director of Public Service be and he is hereby further authorized <br />to purchase through the State Purchasing Program, which was established by O.R.C. Section <br />125.04 and which the City is authorized to pazticipate in pursuant to Ordinance No. 87-6, those <br />items of furniture and furnishings for the New North Olmsted Branch Library that are identified <br />as State Contract Purchase Items, with an estimated total expenditure of $366,140.84, in the <br />Master Worksheet prepared by Spice Constantino Architects and dated July 4, 2003. However, <br />the Director of Finance may require that the Director of Public Service, prior to purchasing any <br />item of furniture or furnishing through the State Purchasing Program, first obtain quotes from at <br />least three other suppliers independent of the State Purchasing Progam, and, if any of the three <br />independent quotes obtained for any such item of furniture or furnishings is lower than the <br />lowest price available through the State Purchasing Program, then the Director of Public Service <br />shall be required to purchase the sa.id item from the supplier that offers the lowest purchase price. <br />If necessary to effectuate any purchase through the State Contract Purchase Program or, in the <br />alternative, from a supplier providing the lowest independent quote, the Mayor is hereby <br />authorized to execute any contracts required by the State or other supplier. Said contract or <br />contracts shall be in a form and substance consistent with the provisions of this Ordinance and <br />approved by the Mayor and the Director of Law. <br />5ECTION 4: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and further <br />for the reason that it is necessary that this Ordinance go into effect immediately so that the <br />timetable for the purchase of furniture and furnishings for the new Library not be delayed and <br />thereby interfere with the scheduled February, 2004, opening of the Library, and further provided <br />it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be <br />in force immediately upon its passage and approval by the Mayor. <br />
