CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2002-142 <br />BY: Mayor Musial <br />AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF <br />NORTH OLMSTED TO ENTER INTO A JOINT FUNDING <br />AGREEMENT WITH THE U.S GEOLOGICAL SURVEY, U.S. <br />DEPARTMENT OF THE INTERIOR, FOR ThTE OPERATIONAND <br />MAINTENANCE OFA GAGE FOR REALTIME DATA COLLECTION, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, the operation and maintenance of a gage for realtime data collection in the <br />Rocky River by the U.S. Geological Survey, U.S. Department of the Interior, benefits the <br />operations of the North Olmsted Waster Water Treatment System; and <br />WHEREAS, it is the desire of this Council to authorize the Mayor retroactively to enter <br />into a joint funding agreement with the U.S. Geological Survey for the period October 1, 2001, <br />through September 30, 2002, to provide said data to the City, and to authorize payment for said <br />services retroactively; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he hereby is authorized to enter into, and the City <br />hereby ratifies, an agreement with the U.S. Geological Survey, U.S. Department of the Interior, <br />for the operation and maintenance of a gage for real time data collection in the Rocky River, for <br />the period October 1, 2001, through September 30, 2002, in substantially the form and substance <br />as the Joint Funding Agreement attached to this Ordinance and marked as "Exhibit A." <br />SECTION 2: That this Council finds that sufficient funds ha.ve been appropriated to meet <br />the obligations of this Agreement, and authorizes and directs the Director of Finance to make <br />payment from the Sewer Revenue Fund for the services rendered by the U.S. Geological Survey <br />under to this Agreement retroactively for the period October 1, 2001, through September 30, <br />2002. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is necessary that this ordinance immediately go into effect upon adoption <br />because of the retroactivity of the start of the time period involved, and further provided it <br />receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be <br />in force immediately upon its passage and approval by the Mayor. <br />
