CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2002 - 138 <br />BY: Mayor Musial <br />A RESOLUTION AUTHORIZING THE MAYOR TO MAKE <br />EMERGENCY UPGRADES TO ONE UNDERGROUND <br />STORAGE TAN%AT THE NORTH OLMSTED MUNICIPAL BUS <br />LINE GARAGE, AND TWO UNDERGROUND STORAGE TANKS <br />AT THE SERVICE GARAGE, WITHOUT PUBLIC BIDDING, <br />AND DECLARING AN EMERGENCY. <br />WHEREA.S, the City has received notification by the Petroleum Underground <br />Storage Tank Release Compensation Board has indicated that piping for one underground <br />storage tank at the North Olmsted Municipal Bus Line Garage and for two underground <br />storage tanks at the Service Garage are in need of immediate upgrade for corrosion <br />protection; and <br />WHEREAS, until such upgrade is made, the Petroleum Underground Storage <br />Tank Relea.se Compensation Board will not provide the City with insurance coverage in <br />the event of a release of fuel from any of the said underground tanks; and <br />WHEREAS, because a release from the underground tanks could constitute an <br />environmental catastrophe subjecting the City, in the absence of sufficient insurance <br />coverage, to monumentai liability, a present emergency exists, the response to which <br />would be unduly delayed by competitive bidding; and <br />WHEREAS, further, Collins Equipment Corporation has been requested to submit <br />a quote for the anticipated upgrades, and, in light of the quote received, it is the opinion of <br />the City Engineer that no savings would likely be achieved by competitive bidding due to <br />the additional costs the City would incur in preparing additional plans and specifications, <br />and advertising; and <br />WHEREAS, it is necessary that the City take immediate action to make the <br />corrosion protection upgrades to the piping for the underground tanks in order to meet its <br />obligation to protect the public health, safety and welfare; <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CIIYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That, subject to approval by the Board of Control, the Mayor be <br />and he hereby is authorized to dispense with competitive bidding and to contract with <br />Collins Equipment Corporation to perform work consisting of corrosion protection
