Ordinance No. 2002-119 <br />Page 2 <br />WHEREAS, this Council, upon review of the study conducted by the Planning Commission, <br />with the assistance of a professional planner, finds that rezoning Parcel E to Mixed Use "D" <br />classification will further, and bears a substantial relation to, the public health, safety, and welfare, <br />and that said rezoning of Parcel E will promote orderly development of a mixed variety of uses on <br />this 24-acre parcel, will serve as an excellent transition district buffering the more intensive <br />commercial development on the south side of Brookpazk Road from the single-family residential <br />neighborhood ta the north of Parcel E, and will generally well serve the interests of the North <br />Olmsted community by encouraging a developmerrt of uses needed within the community and which <br />will improve the City's tax base; <br />WHEREAS, following publication of newspaper notice and notice to the record title holders <br />of real property located within one thousand (1,000) feet of the property proposed to be rezoned, a <br />public hearing was held, in conformance with the provisions of S ion 14 of Article N of the Charter <br />and Section 1127.03 of the Zoning Code, on the & 6 day of 2002. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the Zone Map of North Olmsted is hereby amended, and, as amended, <br />sha11 depict and state that the zoning of the following described parcel of land located within the City, <br />to-wit: Permanent Parcel Number 236-05-001 (main parcel number), referencing Permanent Parcel <br />Nos. 236-05-002 through 236-05-012, 236-05-023 through 236-05-031, 236-05-065, 236-05-066, <br />236-07-016, 236-07-021, 236-07-022, 236-07-025, and 236-07-107, constituting an approximately <br />24 acre vacant parcel of land located along the north side of Brookpark Road between Great <br />Northern Boulevard and Columbia Raad (commonly known as "Parcel E"), is changed from office <br />use district to Mxed Use "D" district. A true and accurate copy of the legal description for "Parcel <br />E" is attached to this Ordinance as Exhibit "A." <br />SECTION 2: That the City Engineer be and he hereby is directed to amend the Zone Map <br />of the City of North Olmsted so that when amended, the said Zone Map will disclose that the zoning <br />classification of the said parcel of land described in Section 1 hereof has been changed from office <br />use district to Mxed Use "D" district, and that said parcel of land may be thereafter used only in <br />accordance with the uses pernutted and the regulations provided in the Mixed Use "D" District of <br />the City pursuant to the applicable provisions of the Zoning Code of the City of North Olmsted as <br />they may be from time to time amended. <br />2 <br />
