<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2002-08 <br />BY: Council Member Kasler <br />A1V ORDINANCE AMENDING SECTION 161. 01(f) OF THE <br />ADMINISTRATIVE CODE OF THE CITY OF NORTH <br />OLMSTED, ENTI7ZED "PAYMENT OF A CCUMULA TED SIC% <br />LEAVE CREDIT, " AND DECLARING AN EMERGENCY, AS <br />AMEIVDED. <br />WHEREAS, Section 161.01(fl of the Administrative Code contains provisions for the <br />payment of unused accumulated sick leave, which provisions establish a schedule of maximum <br />payable sick leave hours in 1993, 1994, 1995 and thereafter; and <br />WHERF4.S, this Council desires to establish a new schedule of maximum payable sick leave <br />hours for the period of January 1, 2002, and thereafter, in order to provide the City's non-bargaining <br />unit employees with the same level of benefits currently provided to bargaining unit employees; and <br />WHEREAS, this Council further desires to define the terms "disability" and "retirement" as <br />referred to in Section 161.01(f) to refer only to disability or service retirements from a state <br />retirement system; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That Section 161.01(f) of the Administrative Code of the City of North <br />Olmsted, which presently reads as follows: <br />"(f) Pavment of Accumulated Sick Leave Credit. An employee shall be paid for unused, <br />accumulated sick leave at the time of disability, retiremerrt or death. Payment sha11 be based upon the <br />basic hourly rate of pay at the time of disability, retirement or death plus longevity and the amount <br />shall be one half of the unused sick leave with a maximum payment of 700 hours <br />in 1993 and 800 hours in 1994 and 900 hours in 1995 and thereafter. In the case of death, such sick <br />leave credit payment shall be made in the following order of precedence: <br />(1) As directed in writing by the employee, <br />(2) If there is no direction in writing, then to the spouse of the employee, <br />(3) If there is no spouse, then to the estate of the employee." <br />
