CITY OF NORTH OLMSTED ORDINANCE NO. 2002-08 BY: Council Member Kasler A1V ORDINANCE AMENDING SECTION 161. 01(f) OF THE ADMINISTRATIVE CODE OF THE CITY OF NORTH OLMSTED, ENTI7ZED "PAYMENT OF A CCUMULA TED SIC% LEAVE CREDIT, " AND DECLARING AN EMERGENCY, AS AMEIVDED. WHEREAS, Section 161.01(fl of the Administrative Code contains provisions for the payment of unused accumulated sick leave, which provisions establish a schedule of maximum payable sick leave hours in 1993, 1994, 1995 and thereafter; and WHERF4.S, this Council desires to establish a new schedule of maximum payable sick leave hours for the period of January 1, 2002, and thereafter, in order to provide the City's non-bargaining unit employees with the same level of benefits currently provided to bargaining unit employees; and WHEREAS, this Council further desires to define the terms "disability" and "retirement" as referred to in Section 161.01(f) to refer only to disability or service retirements from a state retirement system; NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That Section 161.01(f) of the Administrative Code of the City of North Olmsted, which presently reads as follows: "(f) Pavment of Accumulated Sick Leave Credit. An employee shall be paid for unused, accumulated sick leave at the time of disability, retiremerrt or death. Payment sha11 be based upon the basic hourly rate of pay at the time of disability, retirement or death plus longevity and the amount shall be one half of the unused sick leave with a maximum payment of 700 hours in 1993 and 800 hours in 1994 and 900 hours in 1995 and thereafter. In the case of death, such sick leave credit payment shall be made in the following order of precedence: (1) As directed in writing by the employee, (2) If there is no direction in writing, then to the spouse of the employee, (3) If there is no spouse, then to the estate of the employee."
