,. <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2002-98 <br />BY: Council Member Gareau <br />AN ORDINANCE REPEALING ORDINANCE NO. 2002-20, <br />WHICH PROVIDED FOR THE SUBMIS,SION TO THE VOTERS <br />OF A CHARTER AMENDMENT REGARDING INTERIM <br />DIRECTOR APPOINTMENTS, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, this Council, on April 2, 2002, adopted Ordinance No. 2002-20 which provided <br />for the submission to the electors of the City of North Olmsted of an Amendment to the City Charter <br />on the subject of Interim Director Appointments; and <br />WHEREA.S, the Director of La.w subsequent to that date issued a legal opinion that, pursuant <br />to Sections 8 and 9 of Article XVIII of the Ohio Constitution, the legislative authority of a city may <br />only adopt such legislation on a date which occurs no earlier than one hundred twenty days, and no <br />later than sixty days, prior to the date scheduled for the election at which a proposed charter <br />amendment issue will be decided; and <br />WHEREAS, the Director of Law has recommended that Ordinance No. 2002-20 be repealed, <br />and a substitute ordinance be adopted providing for the submission to the voters of the same <br />proposed charter amendment issue as provided for in Ordinance No. 2002-20, so that neither <br />Ordinance No. 2002-20 nor the results of the election to be held on November 5, 2002, may be <br />subject to legal challenge as void under the Ohio Constitution; and <br />WHEREAS, it is accordingly the desire of this Council to repeal Ordinance No. 2002-20 <br />strictly for the reasons stated by the Director of Law; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Ordinance No. 2002-20, entitled "AN ORDINANCE PROVIDING FOR <br />TI-E SUBMISSION TO THE ELECTORS OF THE CITY OF NORTH OLMSTED OF AN <br />AMENDMENT TO ARTICLE III (TI-E MAYOR) OF THE CHARTER OF THE CITY OF <br />NORTH OLMSTED TO AUTHORIZE ELECTED FIRST-TERM MAYORS TO MAKE INTERIM <br />DIRECTOR APFOINTMENTS," adopted by this Council on A.pril 2, 2002, be, and the same hereby <br />is, repealed. <br />
