<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2002- j 0 <br />BY: COUNCILMAN NASHAR <br />AN ORDINANCE READOP77NG ORDINANCE NO. 2000-117 <br />AND THEREBY MAKING PERMANENT SECTION 331.42 OF <br />THE TRAFFIC CODE, ENTITLED "USE OF MOBILE <br />TELEPHONES WHILE OPERATINGA MOTUR VEHICLE, "IN <br />ORDER TO REGULATE THE USE OF MOBILE (CELL) <br />PHONES WHILE OPERATING MOTOR VEHICLES ON <br />ROADS AND STREETS WITHIN THE CITY OF NORTH <br />OLMSTED, " AND DECLARING AN EMERGENCY. <br />WHEREAS, this Council previously adopted Ordinance No. 2000-117, which created new <br />Section 331.42 of the Traffic Code, providing for the regulation of the use of cell phones by <br />drivers of motor vehicles; and <br />WHEREAS, Section 3 of said Ordinance provided that, without further action of this <br />Council, the Ordinance would terminate upon the one year anniversary of the date upon which it <br />first took effect and was in force; and <br />WHEREAS, said Ordinance No. 2000-117 first took effect and was in force on and after <br />January 22, 2001; and <br />WHEREAS, the City police department has recommended that the City continue to <br />regulate the use of cell phones by drivers of motor vehicles as provided for by Ordinance No. <br />2000-117; and <br />WHEREAS, it is accordingly the desire of this Council to re-adopt Ordinance No. 2000- <br />117 and make permanent the regulations of Section 331.42 of the Traffic Code; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the provisions of Ordinance No. 2000-117, creating Section 331.42 of <br />the Traffic Code, which presently reads as follows: <br />11331.42.
