CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2002 - 13 <br />BY: MAYOR MUSIAL <br />AN ORDINANCE AUTHORTZING THE MAYOR TO MAKE <br />EMERGENCY REPAIRS ON THE ELECTRICAL DISTRIBUTION <br />SYSTEM AT THE RECREATION CENTER, WITHOUT PUBLIC <br />BIDDING, AND DECLARING AN EMERGENCY. <br />WHEREAS, recent equipment failure of the Electrical Distribution System at the <br />Recreation Center has indicated that the Electrical Distribution System is in need of <br />immediate replacement andJor repairs of certain portions, and <br />WHEREAS, because Harrington Electric Company has submitted a quote for the <br />anticipated repairs, no savings is anticipated by public bidding due to costs of <br />specifications and advertising, and. <br />WHEREAS, the aforesaid problem has reached such a state that the public <br />bidding and the time associated therewith would be too time consuming to meet the City's <br />obligation to protect the public health, safety and welfare, and <br />WHEREAS, upon the recommendation of the Mayor, this Council deems it an <br />emergency sufficient in magnitude to forego public bidding on said project in order to <br />protect the public health, safety and welfare of the residents of the City. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor, having obtained a quote for said work, be and is hereby <br />authorized to have Harrington Electric Company perform repairs on the Electrical <br />Distribution System. In any event, the cost for said repair sha11 not exceed Fifty Four <br />Thousand Dollars ($54,000.00). Upon approval by the Board of Control, the Mayor be <br />and is hereby authorized and directed to enter into a Contract for same. <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for <br />the further reason that it is immediately necessary to protect the residents, and further <br />provided it receives the affirmative vote of two-thirds of all members of Council, it sha11 <br />take effect and be in force immediately upon its passage and approval by the Mayor. <br />
