AGREEMENT TO PURCHASE REAL PROPERTY This Agreement, entered into at North Olmsted, Ohio this day of 32002 by and between the City of North Olmsted, 5200 Dover Center Road, North Olmsted, Ohio 44070 (hereina.fter, the "Purchaser"), and Sunoco, Inc., c/o Sunoco MidAmerica Marketing & Refining, 500 South Dix Avenue, Detroit MI 48217 (hereinafter the "Seller") WHEREAS, it is the desire of the Seller to sell, and the Purchaser to purchase, a certain portion of the real property located at 23370 Lorain Road, North Olmsted, Ohio, Permanent Parcel #231-12-35, which shall become part of the right-of-way in connection with the proposed widening of Clague Road; and WHEREAS, the purchase of this property has been authorized by North Olmsted Ordinance Number 2002-`; NOW THEREFORE, on the basis of the foregoing premise, for the consideration hereinafter recited, and on the conditions and terms which follow, the parties agree as follows: ITEM 4NE: Purchase and Sale of Real Pronertv Subject to the terms and conditions of this Agreement, the Seller agrees to seil and the Purchaser agrees to purchase a11 of the Seller's right, title and interest in the above-mentioned part of the real property, wluch is located at 23370 Lorain Road, North Olmsted, Ohio. The real property being sold is a somewhat rectangular strip of property running 140.1 feet in length along the Clague Road right-of-way and 45.3 5 feet along the Lorain Road right-of-way, and with a width of 12.66 feet on the north end of the strip and curved to a width of 45.35 feet on the south ?
