<br />AGREEMENT TO PURCHASE REAL PROPERTY <br />This Agreement, entered into at North Olmsted, Ohio this day of 32002 <br />by and between the City of North Olmsted, 5200 Dover Center Road, North Olmsted, Ohio <br />44070 (hereina.fter, the "Purchaser"), and Sunoco, Inc., c/o Sunoco MidAmerica Marketing & <br />Refining, 500 South Dix Avenue, Detroit MI 48217 (hereinafter the "Seller") <br />WHEREAS, it is the desire of the Seller to sell, and the Purchaser to purchase, a certain <br />portion of the real property located at 23370 Lorain Road, North Olmsted, Ohio, Permanent <br />Parcel #231-12-35, which shall become part of the right-of-way in connection with the proposed <br />widening of Clague Road; and <br />WHEREAS, the purchase of this property has been authorized by North Olmsted <br />Ordinance Number 2002-`; <br />NOW THEREFORE, on the basis of the foregoing premise, for the consideration <br />hereinafter recited, and on the conditions and terms which follow, the parties agree as follows: <br />ITEM 4NE: Purchase and Sale of Real Pronertv <br />Subject to the terms and conditions of this Agreement, the Seller agrees to seil and the <br />Purchaser agrees to purchase a11 of the Seller's right, title and interest in the above-mentioned part <br />of the real property, wluch is located at 23370 Lorain Road, North Olmsted, Ohio.
