<br />City of North Royalton, Ohio wastewater treatment facilities and the City of North <br />Olmsted, Ohio wastewater treatmeirt facilities; and <br />WHEREAS, the first Interim Agreement for continuing the stabilization of North <br />Olmsted Wastewater Treatment Plarn Biosolids at the North Royalton Sludge <br />Composting Facility expires on March 31, 2002; and <br />WHEREAS, the Ohio Environmental Protection Agency will allow the City af North <br />Olmsted, Ohio and the City of North Royalton, Ohio to continue the stabilizing of North <br />Olmsted Wastewater Treatment Plant biosolids at the North Royalton Sludge Composting <br />Facility on an interim basis while the Ohio Environmental Protection Agency completes <br />it review of sludge management planning modifications prepared and submitted by both <br />the City of North Olmsted, Ohio and the City af North Royalton, Ohio to the agency; and <br />WHEREAS, the Board of Contral of the City of North Olmsted, Ohio met on <br />, 2002, as authorized by the Charter of the City pf <br />North Olmsted, Ohio and upon the recommendation of the Mayor, awarded this second <br />Interim Agreement with the City of North Roya.lton, Ohio, and <br />WHEREAS, the City Council of North Royalton, authorized the Mayor of North <br />Royaltqn to enter into this second Interim Agreement with the City of North 4lmsted. <br />NQW, T'HEREFORE, in consideration of the foregoing recital and the cavenants and <br />agreements of the parties herein set forth, the parties do agree as fdlows: <br />SE!QTION I - TIME PERIOD <br />A. The term of this Second Interim Agreement shall be April l, 2002 to and including <br />December 31, 2002. <br />B. The term of this Second Interim Ageement may be extended beyond December 31, <br />2002, for a definite period or periods of time, upon the mutual agreement of the <br />City of North Royalton, Ohio and the City of North Olmsted, Ohio and a duly <br />authorized modification of this agreement if the length af time required by the Ohio <br />Environmental Protection Agency to review and approve modifications to the <br />sludge management plans of each city exceeds the December 31, 2002 tetmination <br />date of this Agreement. <br />SECTION II- DOCUMENTS INCORPOR.ATED BY REFERENCE <br />A. The September 6, 2001 City of North Olmsted, Ohio revised pilat testing plan af <br />study memorandum recommending a second phase of pilot testmg for the <br />stabilization of North tJlmsted VVastewater Treatment Plant Biosolids at #he City of <br />North Rayalton, Ohio Sludge Cvmposting Facility by the City of North Royalton, <br />onio. <br />C.
