City of North Royalton, Ohio wastewater treatment facilities and the City of North Olmsted, Ohio wastewater treatmeirt facilities; and WHEREAS, the first Interim Agreement for continuing the stabilization of North Olmsted Wastewater Treatment Plarn Biosolids at the North Royalton Sludge Composting Facility expires on March 31, 2002; and WHEREAS, the Ohio Environmental Protection Agency will allow the City af North Olmsted, Ohio and the City of North Royalton, Ohio to continue the stabilizing of North Olmsted Wastewater Treatment Plant biosolids at the North Royalton Sludge Composting Facility on an interim basis while the Ohio Environmental Protection Agency completes it review of sludge management planning modifications prepared and submitted by both the City of North Olmsted, Ohio and the City af North Royalton, Ohio to the agency; and WHEREAS, the Board of Contral of the City of North Olmsted, Ohio met on , 2002, as authorized by the Charter of the City pf North Olmsted, Ohio and upon the recommendation of the Mayor, awarded this second Interim Agreement with the City of North Roya.lton, Ohio, and WHEREAS, the City Council of North Royalton, authorized the Mayor of North Royaltqn to enter into this second Interim Agreement with the City of North 4lmsted. NQW, T'HEREFORE, in consideration of the foregoing recital and the cavenants and agreements of the parties herein set forth, the parties do agree as fdlows: SE!QTION I - TIME PERIOD A. The term of this Second Interim Agreement shall be April l, 2002 to and including December 31, 2002. B. The term of this Second Interim Ageement may be extended beyond December 31, 2002, for a definite period or periods of time, upon the mutual agreement of the City of North Royalton, Ohio and the City of North Olmsted, Ohio and a duly authorized modification of this agreement if the length af time required by the Ohio Environmental Protection Agency to review and approve modifications to the sludge management plans of each city exceeds the December 31, 2002 tetmination date of this Agreement.
