CITY OF NORTH OLMSTED ORDINANCE NO. 2002-26 BY: MAYOR MUSIAL AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF NORTH OLMSTED TO ENTER INTO AN AGREEMENT WITH THE STATE OF OHIO PROVIDING FOR A FACE-TO-FACE CURB RESURFACING OF LORAIN ROAD FROM T'HE LORAIN COUNTY LINE TO BROOKPARK ROAD (SR 17), AND DECLARING AN EMERGENCY. WHEREAS, the City has applied for State Highway funding for the repair and resurfacing of Lorain Road from the Lorain County Line to Brookpark Road; and WHEREAS, the State of Ohio has approved the funding request and will provide eighty- percent (80%) of the funding for the said project, said eighty percent (80%) not to exceed One Million One Hundred Ninety-Two Thousand Dollars ($1,192,000.00); and WHEREAS, it is the desire of this Council to authorize the Mayor to enter into an Agreement with the State of Ohio for the purpose of accepting the funding proposed and establishing the responsibilities for the administration of the said project by the City and the Ohio Department of Transportation; and WHEREAS, to protect funding, it is necessary that this Agreement be authorized, if at all, and transmitted to the Ohio Department of Transportation no later than by the end of February, 2002; NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That the Mayor be and he hereby is authorized to enter into an Agreement with the State of Ohio providing for funding the repair and resurfacing of Lorain Road from the Lorain County Line to Brookpark Road, in substantially the form and substance as evidenced in the "Non-Traditional Non-Federal Project Agreement," attached to this Ordinance as "Exhibit A." SECTION 2: That this Council finds that sufficient funds have been appropriated and set aside to pay all monies which will come due under the said Agreement_
