<br />A <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2002-30 <br />BY: MAYOR MUSIAL <br />AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF <br />NORTH OLMSTED TO ENTER INTO AN AGREEMENT WITH <br />MEDINA COUNTY BOARD OF COUNTY COMMISSIONERS, <br />PROVIDING FOR THE 5AID BOARD TO HOUSE NORTH <br />OLMSTED PRISONERS AT THE MEDINA COUNTY JAIL, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, due to overcrowding, Cuyahoga County is no longer accepting <br />misdemeanant prisoners from North Olmsted sentenced under the State Code; and <br />WHEREAS, the City of North Olmsted Municipal Jail is a five-day holding facility only, <br />and may not house prisoners sentenced for misdemeanor convictions for periods which exceed <br />five days; and <br />WHEREAS, it is necessary, in light of the refusal of Cuyahoga County to house our <br />misdemeanant prisoners, to make provision for the housing of these prisoners elsewhere; and <br />WHEItEAS, the Medina County Commissioners are willing to house North Olmsted <br />misdemeanant prisoners, who are sentenced to more than five (5) days imprisonment, at the <br />Medina County Jail, at a per diem charge which is equal to the amount which the City presently <br />receives by way of reimbursement by Cuyahoga County for the housing of misdemeanant <br />prisoners sentenced under the State Code; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the Mayor is hereby authorized to enter into an agreement with the <br />Medina County Boazd of County Commissioners, providing for the housing of City of North <br />Olmsted's misdemeanant prisoners sentenced under the State Code, in substantially the form and <br />substance of the Agreement which is attached to this Ordinance as Exhibit A, and incorporated <br />herein by reference. <br />SECT70N 2: That this Council expressly determines that this is not a contract involving <br />an expenditure of public funds for which public bidding is required pursuant to Article VIII, <br />Section b, of the Charter.
