Deichmann, P.E. <br />City Engineer <br />CITY OF NORTH OLMSTED <br />TEMPORARY RIGHT-OF-ENTRY AGREEMENT <br />23385 LORAIN ROAD <br />ADDRESS <br />237-09-004 <br />PERMANENT PARCEL NUMBER (S) <br />I/We, the undersigned property owner(s) (hereafter known as Owner), hereby permit the City of <br />North Olmsted (hereafter known as City), and/or its agents to enter upon our property, effective <br />Friday, March 15, 2002, through , 2002 for the purpose of improving, the <br />Clague Road roadway in the immediate vicinity of Lorain Road. Said work is further described <br />as; <br />partial re-construction of driveways, curbs and landscape area <br />and as shown on the attached drawing. <br />It is further agreed that the owner wili save the City and/or its agents harmless from any damage <br />to our property, except as set forth in the purchase agreement between the parties dated Maxch <br />_, 2002 or as determined by the City nor further claims of any nature whatsoever. <br />It is further agreed that the City will save the owner and/or its agents harmless from any damage <br />to the property, except as set forth in the purcnase agreement between the parties dated March <br />_, 2002 or as determined by the owner nor further claims of any nature whatsoever. <br />This temporary right of way is granted for the period of time necessary to complete said work <br />and will terminate upon completion and acceptance of said work by the City of North Olmsted, <br />but not later than set forth above. <br />City agrees that its entry on Owner's property and the construction of the improvements shall in <br />no event interfere with Owner's business operations on the property, including without <br />limitation, that its entrances shall not be closed to vehicular traffic, except during trenching and <br />then only for the period of time absolutely necessary.
