. .?,? <br />reb U 02 10:10a suresite <br />440 97.4 Modification Rider to the PCS Site Agreement <br />Page 1 of 1 <br />site Name: AT87 North Oimated Playground Site LD.: CLOOXC366 - D GROUND LEASE ONLY <br />This Rider is made and entered into by and between <br />The City of North Qlmsted <br />('Owner") <br />AND <br />SprintCom, Inc., a Kansas corporation <br />for attachment to the PCS Site AgreemeM Dated <br />("SprintCom') <br />("Agreemerrt"). <br />1. This rider is irx:orporated into and constitutes an iMegral part of the PCS Site /{qreement to which it is attached. The terms <br />used herein whiCh are defined or specc;iffied in the PCS Site Agraement shall have the meanengs indicated in the PCS Srte <br />Agreement where the cxontent permits and unfess otherMse indicated herein, and definitions of tetms set forth herein shall <br />apply to the PCS Site Agreement where the cnoniext permlts. If there are any inconsistendes between the provisions of this <br />Rider and ihe provisions of tlie PCS Site Agreement, the provisions of this Rider shall contral. <br />2. Paragraph 3. ia deletad in its entirety and replaced with a new Paragraph 3. to read as follows: Until that date which is <br />30 days after the start of construdion, the rent will be a one-time aggregate paytnent of $100.00, the receipt of which Owner <br />adcnowtedges. "fhereaRer, rent will he paid in equal monthly installments af Six Hundred and 00I100 Dollars ($600.00) (until <br />increased as set forth herein), partial months to be prorated, in advance. In addfion, a one-bme payment of $12,000 towards <br />wnsuuction o# restrooms at the site virill be paid abng with the firsi months` rerK. Rent shall be increased annually by the <br />amount of the mortthiy instatlment of reM payable doring the preceding year increased hy 3%. <br />3: The following shall be added aa Paragraph 21. Separate Tower Lease. This Agreernent is a ground Iease onty.
