CITY 4F 1vORTH OLMSTED <br />ORDINANCE NO. 2002-48 <br />By: Mayor Musial <br />AN ORDINANCE DESIGNATING THE REVENUES DERIVED FROM THE Ca <br />LOCA TION OF SPRIIVT FGS ON THE AT & T MONOPDLE AT CLAGUE PARK, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, this Council previously adopted Ordinance No. 97-74, providing for a split <br />between the Economic Development Fund and the Recreation Fund of the revenues generated by <br />leases of city-owned property involving the location of telecommunication facilities; and <br />WHERF.A.S, it is the desire of this Council to split the revenues generated by the co-location <br />of Sprint PCS on the AT & T monopole at Clague Park, in the same percentages as was provided for <br />in Ordinance No. 97-74 for the AT & T Wireless lease revenues; <br />NOyi; THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OI.MSTED, COUNTY 4F CUYAHOGA AND STATE OF OHIO: <br />SECfiIDN 1: That twenty-five percerrt (25%) of the cash downpayment received from Spring <br />PCS in connection with its co-location on the AT & T monopole at Clague Park shall be designazed <br />to the Economic Developmern Fund established by Ordinance No. 93-24, and the remaining seventy- <br />five perc.ent (75%) of said downpaymern and all other revenues received by the City from the Sprint <br />PCS Wireless co-location on the AT & T monopole at Clague Park sha11 be designated to the City's <br />Recreation Fund. <br />SECTION Z: That the Director of Finance be and she is hereby directed to record the receipts <br />from said co-location of Sprint PCS on the AT & T monopole at Clague Park consistent with the <br />provisions of this Ordinance. <br />SECTION 3: That the Clerk of Council shall immediately forward an attested copy of this <br />Ordinance to the Auditor of Cuyahoga County and the Auditor of the State of Ohio. <br />SECTION 4: That any Ordinance, or part of Ordinance, including Ordinance No. 97-74, <br />which is in conflict or is inconsistent with the provisions of this Ordinance, sha11, to the extent of any <br />such conflict or inconsistency, be repealed.
