<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2002-52 <br />BY: Council Members Kasler, Gareau, Nashar, McKay and Miller <br />AN ORDINANGE AMENDING SECTIONS 351.04 AND 351.20 OF THE TRAFFIC <br />CODE IN ORDER TO .REMOVE FROM CHAPTER 351 Di7PLICATIVE <br />PROVISIONS RELATING TO HANDICAPPED PARKING VIOLATIONS AND <br />PROVISIONS WHICH PROPERLY BELONG IN CHAPTER 1161 OF THE <br />ZONIIVG CODE, AND FURTHER TO BRING THE SUBSTANTIVE PROVISIONS <br />OF SECTION 351.20 UP TO STATE CODE; AMENDING ORDIIVANCE NiIMBER <br />2001-12 7 SO THAT IT IS CONSISTENT WITH THE FOREGOING CHANGES TO <br />SEC770NS 351.04 AND 351.20; AND DECLARING AN EMERGENCY. <br />WHEREAS, the Director of Law, upon reviewing the substantive provisions of Chapter <br />351 of the Traffic Code, has made recommendations to this Council to remove certain <br />duplicative provisions relating to handicapped parking violations and c+ertain provisions relating <br />to handica.pped parking spaces which properly belong in the Zoning Code; and <br />WHEREAS, it is the desire of this Council to adopt the recommendations of the Director <br />of Law and to amend Sections 351.04 and 351.20 ofthe Traffic Code accordingly; and <br />N'HEREAS, it is further the desire of this Council ta bring the substantive provisions of <br />Section 351.20 up to State Code; and <br />WHEREAS, it is further the desire of this Council to atnend Ordinance Number 2001- <br />127, relating to the disposition of handicapped parking violation fines into the senior emergency <br />fund to reflect the changes made to Sections 351.04 and 351.20 of the Traffic Code relating to <br />handicapped parking violations; <br />1VOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STA TE OF OHIO: <br />SECTION l: That Section 351.04 of the Traffic Code, entitled "Parking Near Curb; <br />Handicapped Locations on Public and Private Lots and Garages," which preserrtly reads as <br />follows: <br />"351.04 PARIMG NEAR CURB; HANDICAPPED LOCATIONS <br />ON PUBLIC AND PRIVATE LOTS AND GARAGES. <br />(a) Every vehicle stopped or parked upon a roadway where there is an <br />adjacem curb shall be stopped or parked with the curb side wheels of the vehicle <br />parallei with and not more than twelve inches from the curb, unless it is <br />impossible to approach so close to the curb; in such case the stop shall be as close <br />to the curb as possible and only for the time necessary to discharge and receive <br />passengers or to load or unload merchandise. <br />
