• 3.1.4 Provide to CONTRACTOR all availa.ble data and informa.tion in the possession of the CITY, as needed by CONTRACTOR, relevant to the design and construction of the New North Olmsted Branch Library. This da.ta and information may include: (1) data prepared by others, including Phase I Environmental Assessments and appropriate professional interpretations thereof; (2) property survey and boundary information; (3) property descriptions, zoning, deed and other land use restrictions; and (4) other necessary data and consultations. 3.1.5 Perform all the tasks and subtasks identified as obligations of the CITY in APPENDIX B 1, referred to in Exhibit I attached to this Agreement 3.1.6 Crive prompt written notice to CONTRACTOR whenever the CITY observes or otherwise becomes aware of any event that affects CONTRACTOR's performance of its duties and obligations under Section 1. SECTION 4. TIME SCHEDULE 4.1 Unless otherwise directed by the CITY, the CONTRACTOR sha.ll commence the performance of the Section 1. Basic Services upon execution af this Agreement by both parties that shall constitute Authorization to Proceed. Time is of the essence in this Agreement for the Basic Section 1 Services. 4.2 The CONTRACTOR recognizes that the services u.nder this Agreement are to be performed as expeditiously as practicable. The CONTRACTrJR shall make every reasonable effort to substantially complete the Section 1. Basic Services within the time set forth in Exhibit III, Time Schedule, attached hereto and made a part hereof. SECTION 5. AMOUNT AND METHOD OF PAYMENT. 5.1 For services provided under Section 1. Basic Services, payment shall be ma.de in accordance with Exhibit II, Method of Payment. 5.2 All invoices shall be in the format requested by the CITY as referenced in Exhibit II, Method of Payment. 3
