,wow <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2002-62 <br />BY: Mayor Musial <br />AN ORDINANCE Ai7THORIZING THE DIRECTOR OF PUBLIC <br />SERVICE TO REQUEST PROPOSALS FOR GEOTECHNICAL <br />ENGINEERIIVG SERVICES FOR THE NEW NORTH OLMSTED <br />BRANCH LIBRARY; FURTHER, AUTHORIZING THE MAYOR <br />TO ENTER INTO AN AGREEMENT WITH THE FIRM <br />S'ELECTED IN THE RFP PROCESS; AND DECLARING A1V <br />EMERGENCY. <br />WHEREAS, the City is in the design phase for the New North Olmsted Branch <br />Library; and <br />WHEREAS, the Architect for the design of the New North Olmsted Branch Library <br />requires certain geotechnical engineering data and information to complete its design work; <br />ana <br />WHEREAS, the budget for the New North Olmsted Branch Library includes a <br />Professional Specialty Services line item containing sufficiem funds for retaining the services of <br />a qualified engineer to obtain the geotechnical data and information required by the Architect <br />for its design phase work; and <br />WHEREAS, it is the desire af this Council to authorize the Director of Public Service <br />to request praposals from qualified engineers, and further to authorize the Mayor, upon <br />approval by the Board of Control, if necessary, to enter into an Agreement with the engineer <br />seiected; <br />NOW, THEREFORE, BE IT ORDAINED BY THE C4UNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Director of Public Service be and he hereby is authorized to <br />request proposals from qualified engineers for geotechnical engiaeering services for the design <br />phase of the New North Olmsted Branch Library consistent with the May 2002 Request for <br />Proposal - Geotechnical Services, attached to this Ordinance as Exhibit A. <br />SECTION 2: That the Mayor be and he hereby is authorized, upvn approval of the <br />Board of Controi, if necessary, to enter into an Agreement with the engineer selected in the <br />RFP (Request for Proposal) process in substantially the form as the Agreement attached tv this <br />Ordinance as Exhibit B, with only such changes to be hereinafter made as are not substantially <br />adverse to the City and which are approved by both the Mayor and the Director of Law. The <br />character of any such changes as not being substantially adverse to the City shall be evidenced <br />conclusively by the execution of the Agreement by the Mayor and the approvai of the <br />Agreement by the I?irector of Law.
