CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2002-63 <br />BY: Mayor Musial <br />AN O.RDINANCE AUTHORIZING THE DIRECTOR OF PUBLIC <br />SERVICE TO REQUEST PROPOSALS F4R THERMAL <br />CONDUCTIVITY TESTING SERVICES FOR THE NEW NORTH <br />OLMSTED BRANCH L,IBRARY; FITRTHEA AUTHORIZING <br />THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE <br />FIRM SELECTED IN THE RFP PROCESS; AND DECLARING <br />AN EMERGENCY. <br />WHEREAS, the City is in the design phase for the New North Olmsted Branch <br />Library; and <br />WHEREAS, the Architect for the design of the New North Olmsted Branch Library <br />requires certain thermal conductivity data and inforniation to complete its design work; and <br />N'HEREA,S, the budget for the New North Olmsted Branch Library includes a <br />Professional Specialty Services line item containing sufficient funds for retaining the services of <br />a firm to obtain the thermal conductivity data and information required by the Architect for its <br />design phase work; and <br />WHEREAS, it is the desire of this Council to authorize the Director of Public Service <br />ta request proposals from qualified firms, and further to authorize the Mayor, upon approval <br />by the Board af Control, if necessary, to enter into an Agreement with the firm selected; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Director of Public Service be and he hereby is authorized to <br />request proposals for thermal conductivity professional services for the design phase of the <br />New North Olmsted Branch Library consistent with the June 2002 North Olmsted Branch <br />Library Request for Proposal - Thermal Corrductivity Testing, attached to this Ordinance as <br />Exhibit A. <br />SECTION 2: That the Mayor be and he hereby is authorized, upon approval of the <br />Board of Control, if necessary, to enter into an Agreement with the firm selected in the RFP <br />(Request for Proposal) process in substantially the form as the Agreement attached to this <br />Ordinance as Exhibit B, with only such changes to be hereinafter made as are not substantially <br />adverse to the City and which are approved by both the Mayor and the Director of Law. The <br />character of any such changes as not being substantially adverse to the City shall be evidenced <br />conclusively by the execution of the Agreement by the Mayor and the approval of the <br />Ageement by the Director of Law. <br />C
