CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2002-65 <br />BY: Council Member Gareau <br />AN ORDINANCE PROVIDING FOR THE SUBMISSION TO <br />THE ELECTORS OF THE CITY OF NORTH OLMSTED OF <br />AMENDMENTS TO ARTICLE Ill, SECTIONS 3 AND S(b); AND <br />ARTICLE VIl, SECTIONS 1(a), 2(a), AND 4(a) OF THE <br />CHARTER OF THE CITY OF NORTH OLMSTED TO REMO ilE <br />ALL REFERENCES TO VOTING BY `BLECTED" MEMBERS <br />OF COUNCIL. <br />BE IT ORDAINED by the Council of the City of North Olmsted, County of <br />Cuyahoga, Ohio, two-thirds of all members concurring that: <br />S,ECTION 1: Pursuam to Article XVIII, Section 9 of the Ohio Constitution, and Article XII <br />of the Charter of the City of North Olmsted, this Council authorizes and directs that the following <br />proposal to amend the Charter of the City of North Olmsted be submitted to the electors of the City <br />of North Olmsted at an election to be held at the usual places of voting in the City on Tuesday, <br />November 5, 2002: <br />That Article III, Sections 3 and 5(b); and Article VII, Sections 1(a), 2(a) and 4(a) of <br />the Charter be amended by removing all references therein to voting by "elected" members of Council <br />so that, as amended, these sections, or parts of sections as applicable, shall read as follows: <br />Article III <br />THE MAYOR <br />5EC. 3 REMOVAL. <br />The Council may remove the Mayor for his disqualification while in office, for his conviction <br />while in office of a crime involving moral turpitude, or for a violation of his oath of office provided, <br />however, that such removal shali not take place without the concurrence of two-thirds of the <br />members of Council nor until the Mayor sha11 have been notified in writing of the charge against him <br />at least ten (10) days in advance of any hearing upon such chazge and he and his counsel have been <br />given an opportunity to be heard, present evidence, and examine any witness appearing in support <br />of such charge. <br />SEC. 5 DUTIES AND POWERS OF THE MAYOR. <br />(b) Leg,islative Powers. Every ardinance passed or resolution adopted by the Council shall <br />be attested by the Clerk of Council and promptly presented to the Mayor. If the Mayor approves
