. <br />Ordinance No. 2002-65 <br />SEC. 4 BOARD OF ZOIVING APPEALS. <br />(a) Membershin. The Boazd of Zoning Appeals shall consist of five (5) members, who <br />sha11 be qualified electors of the municipality not holding other municipal office, who shall be <br />appointed by the Ma.yor, subject to approval by the majority of the members of Council. The term <br />of the present members of the Board sha11 terminate on December 31, 1959. Those members <br />appoirrted to this Board, shall be appointed for a term of five (5) years, except that of the five <br />appointed for the term beginning 7anuary 1, 1960, one shall be appointed for a term of one year, <br />one for a term of two years, one for a term of three years, one for a term of four years, and the <br />fifth member for a full term of five years. Any member of the Board of Zoning Appeals may be <br />removed for any cause by a vote of two-thirds of the members of Council. Any vacancies <br />occurring during the term of any member of the Board, sha11 be filled in a manner authorized for <br />an original appointment. <br />SECTION 2. Ifthe foregoing proposal receives the affirmative vote of a majority of the <br />electors voting thereon, then the said amendments to Article III, Sections 3 and 5(b), and to <br />Article VII, Sections 1(a), 2(a) and 4(a), sha11 be effective as ofthe eazliest date provided by law. <br />SECTION 3. It is the desire of the Council that the ballot for said question shall be in <br />substantially the following form: <br />PROPOSED CHARTER AMENDMENT <br />A majority affirrnative vote is necessary for passage. <br />Sha11 Article III, Sections 3 and 5(b), and Article VIi, Sections 1(a), <br />2(a), and 4(a) of the City Charter be amended so as to remove from <br />the Charter all references to voting by "elected" members of Council, <br />thereby giving full and equal voting powers to both elected and <br />appointed members of Council? <br />1:1 Yes <br />1:1 No <br />SECTION 4. The Clerk of Council is authorized and directed to deliver a certified copy of <br />this ordinance to the Board of Elections of Cuyahoga County no sooner than July 8, 2002, and no <br />later than September S, 2002.
