J, CITY OF NORTH 4LMSTED ORDINANCE NO. 2002 - 70 BY: Mayor Norman T. Musial AN ORDINANCE AUTHORIZING THE MAYOR TO CONTRACT FOR THE IMMEDIATE REPLACEMENT OF TIiE THICKENED PRIMARY SLUDGE LINE AT THE WASTEWATER TREATMENT PLANT, AND DECLARING AN EMERGENCY. WHEREAS, a section of the Thickened Primary Sludge Line at the North Olmsted Wastewater Treatment Plant ruptured on April 26, 2002, said line having been constructed in 1970 and which excavation was backfilled with foundry sand, and WHEREAS, there is an emergency need to immediately replace said line in order to continue safe operation of the Wastewater Treatment Plant and to prevent spillage of contaminates into the environment injurious to the public health, safety and welfare and WHEREAS, on April 30, 2002, the City requested an emergency quotation from NERONE & SONS, INC. to construct approximately 2001ineal feet of line to replace the failed section and other sectians of the Thickened Primary Sludge Line; and WHEREAS, NERONE & SONS, INC. provided a quotation on April 30, 2002 for construction of a Thickened Primary Sludge Replacement Line for the price of $30,600.00 and WHEREAS, the Director of Public Service has determined that NERONE & SONS, INC. has provided the City, in light of the emergency, with a rea.sonable quotation for the replacement of the failed section, and other sections, of the Thickened Primary Sludge Line; and WHEREAS, this Council deems that an emergency condition injurious to the public health, safety and welfare eausts requiring a dispensing of competitive bidding for said line replacement; and WHEREAS, it is the desire of this Council to therefore authorize the Mayor to enter into an Agreemem with NERONE & SONS, INC. to replace said line on an emergency basis; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHUGA, AND STATE OF OHIO: SECTION 1: That the Mayor be and he is hereby authorized to, upon approvai by the Board of Control, enter into a Contract in the amount of $30,600.00 with NERONE & SONS, INC. , and execute same on behalf of the City of North Olmsted. The Contract shall be in subStantially the form as the Agreement marked as Exhibit A and attached hereto.
