<br />Ordinance No. 2002-76 <br />WHEREAS, the City of Cleveland Water Department, the sewer use billing agent for the <br />City of North Olmsted, is not capable of issuing quarterly sewer charge bills for use of the <br />System if a user consumes less than 1.0 mcf in any quarterly billing period (i.e. quarter); and <br />WHEREAS, however, the City of Cleveland Water Department is capable of recording <br />and generating a report identifying the users of the System who consume less than 1.0 mcf in any <br />quarterly billing period; and <br />WHEREAS, the City of North Olmsted can obtain annually a report from the City of <br />Cleveland Department of Water identifying the users of the System who consume less than 1.0 <br />mcf in any of the four preceding quarterly billing periods; and <br />WHEREAS, consistent with the recommendations made, it is the desire of this Council <br />to modify the current sewer rate structure as set forth in Section 915.04 of the Codified <br />Ordinances of the City so as to eliminate the 1.0 mcf per quarter minimum sewer use charge for <br />the OM&R component of the sewer rate for North Olmsted users; and <br />WHEREAS, this rate change will apply only to North Olmsted users, because, first, the <br />City will incur additional administrative expenses in implementing this change which will not be <br />entirely born by the Sewer Fund; secondly, because North Olmsted residents and businesses, <br />through their payments of real property and income taxes to the City, have contributed more <br />substantially to System capital improvements and operations; thirdly, because there are <br />expenditures made from the City's General Fund, particularly expenditures involving <br />maintenance, repair and improvement of storm sewer ditches, which have conferred benefits on <br />the System; and fourthly, the City's obligations to non-residents are established by contract, <br />rather than by law, and are subject to alteration only through the contract process of negotiation <br />and agreement; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OffiO: <br />SECTION 1: That Section 915.04 (User Charges) of Chapter 915 of the Codified <br />Ordinances, which presently reads as follows: <br />"915.04 USER CHARGES. <br />(a) All premises within the corporation limits of the City shatl pay a sewer user charge <br />based upon the quantity of water used on the premises as shown by the records of the Division of <br />Water of the City of Cleveland, unless specified otherwise in this chapter. <br />The user rates shall be broken down as follows: <br />(1) A portion will be established to cover the costs incurred for the operation, <br />maintenance and replacement of the system. <br />(2) A second portion will be established to cover costs of debt reduction and capital <br />improvements. All revenues shall be <br />deposited in the Sewer Revenue Fund. <br />
