CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2002-77 <br />By: Mayor Musial <br />AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT <br />FOR THE PURCHASE OF A PORTION OF THE CLAGUE TOWERS <br />CONDOMINIUM OWNERS' ASSOCIATION, INC. PROPERTYLOCATED AT 3675 <br />CLAGUE ROAD, NORTH OLMSTED, OHIO (PERMANENT PARCEL NOS. 231-12- <br />001 THROUGH231-12-395) FOR THE PURPOSE OF WIDENING CLAGUE ROAD, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, this Council has reviewed plans and approved financing for the proposed <br />widening of Clague Road at and near its intersection with Lorain Road; and <br />WHEREAS, this Council heretofore authorized and directed the Director of Law of the City <br />of North Olmsted to negotiate for the acquisition of all property necessary for the said road widening <br />project; and <br />WHEREAS, it is necessary, for the road widening project, to acquire a portion of the real <br />property owned by Clague Towers Condominium Owners' Association, Inc., located at 3675 Clague <br />Road and identified as Permanent Parcel Nos. 231-12-001 through 231-12-395; and <br />WHEREAS, the Director of Law has, consistent with the order of Council to do the same, <br />successfully negotiated a contract with The Clague Towers Condominium Owners' Association, the <br />owners of said property located at 3675 Clague Road, a copy of which is attached hereto and marked <br />Exhibit "A". <br />NOW, THEREFORE, BE IT ORDAIIVED BY THE COU1VCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized and directed to enter into an <br />Agreement in substantially the form as that which is attached hereto and made a part hereof and <br />marked Exhibit "A," with The Clague Towers Condominium Owners' Association, Inc. for the <br />acquisition of a portion of their property located at 3675 Clague Road, North Olmsted, Ohio, in <br />connection with the Clague Road Widening Project. The purchase price for the property acquired <br />is Five Thousand Six Hundred ($5,600.00) Dollars.
