CITY OF NORTH OLMSTED ORDINANCE NO. 2002-78 By: Mayor Musial AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT FOR THE PURCHASE OF A PORTION OF THE MONGELLO PROPERTY LOCATED AT 3683, 3685, 3687 AND 3689 CLAGUE ROAD, NORTH OLMSTED, OHIO (PERMANENT PARCEL NO. 231-12-1 7) FOR THE PURPOSE OF WIDENING CLAGUE ROAD, AND DECLARING AN EMERGENCY WHEREAS, this Council has reviewed plans and approved financing for the proposed widening of Clague Road at and near its intersection with Lorain Road; and WHEREAS, this Council heretofore authorized and directed the Director of Law of the City of North Olmsted to negotiate for the acquisition of all property necessary for the said road widening project; and WHEREAS, it is necessary, for the road widening project, to acquire a portion of the real property owned by Richard C. Mongello and Joan M. Mongello, co-trustees, located at 3683, 3685, 3687 and 3689 Clague Road and identified as Permanent Parcel No. 231-12-17; and WHEREAS, the Director of Law has, consistent with the order of Council to do the same, successfully negotiated a contract with Richard C. Mongello and Joan M. Mongello, co-trustees, the owners of said property located at 3683, 3685, 3687 and 3689 Clague Road, a copy of which is attached hereto and marked Exhibit "A". NOW, THEREFORE, BE IT ORDAINED BY THE COiINCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That the Mayor be and he is hereby authorized and directed to enter into an Agreement in substantially the form as that which is attached hereto and made a part hereof and marked Exhibit "A," with Richard C. Mongello and Joan M. Mongello, co-trustees, for the acquisition of a portion of the property located at 3683, 3685, 3687 and 3689 Clague Road, North Olmsted, Ohio, in connection with the Clague Road Widening Project. The purchase price for the property acquired is Eighteen Thousand ($18,000.00) Dollars. .. ._ ....,.,. ,?..
