CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2002 - 80 <br />By: Councilman George Nashar and Councilman Dean McKay <br />AN ORDINANCE AMENDING SECTION 1139.02 (MOTORIST <br />SERVICE DISTRICT) OF THE ZONING CODE IN ORDER TO <br />PROVIDE FOR ADDITIONAL PERM=D USES UFONLAIVD <br />ZONED FOR MOTORIST'SERVICE DISTRICT USE. <br />WHEREAS, the Zoning Code of the City of North Olmsted presently includes therein <br />Section 1139.02 of Chapter 1139 which provides for Motorist Services District uses; and <br />WHEREAS, there is currently no land in North Olmsted zoned for Motorist Services <br />District use; and <br />WHEREAS, one area of the City that may be appropriate for rezoning to Motorist <br />Service District use is the westerly area of North Olmsted along Lorain Road at the county line <br />near the Rt. 10 and I-480 interchange; and <br />WHEREAS, because Motorist Service District use may be an appropriate zoning <br />classification in the future for this, or other, areas of the City tocated near interchanges, it is <br />appropriate to review the current permitted uses in Section 1139.02 to determine whether the <br />Code should be updated and/or modified in order to meet cunent conditions and prospective <br />business and City needs, consistent with changing economic, social and technological conditions; <br />and <br />WHEREAS, following review by the Planning Commission and the BZD committee of <br />Council, this Council believes that Section 1139.02 of the Zoning Code should be amended to <br />provide for additional permitted uses in Motorist Service Districts, to-wit: Recreational and <br />Sports facilities providing organized, league and open team play in indoor or outdoor facilities; <br />Places providing retail printing, duplicating and wire communications, such as fax transmissions, <br />e-mail and internet services; Convention facilities including trade shows, meeting facilities, and <br />other organized events associated with business promotion and display; and Drive-in banking <br />facilities, all of which said new uses will substantially further the City's legitimate interests in <br />providing for such zoning classification and its associated uses; and <br />WHEREAS, the Planning Commission an the 23rd day of April, 2002, by formal motion <br />recommended that an Ordinance amending section 1139.02 of the Zoning Code (Motorist Service <br />District) in substance as stated above be initiated; <br />
