CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2002-82 <br />BY: Mayor Musial <br />AN ORDINANCE AMENDIIVG SECTION 955.02 OF CHAPTER 955 OF THE <br />CODIFIED ORDINANCES (SALE OF SURPL IIS PERS'ONAL PROPERT'I) TO <br />A UTHORIZE THE DIRECTOR OF PUBLIC SERVICE TO DISPOSE OF SIIRPL IIS <br />PERSONAL PROPERTY WITH A FAIR MARKET VALUE OF LESS THAN ONE <br />THOUSAND FIVE HUNDRED DOLLARS WITHOUT COUNCIL APPROVAL, AND <br />BYAUCTION, AND DECLARING AN EMERGENCY. <br />R'HEREAS, Section 955.02 of the Codified Ordinances provides for the disposition of <br />surplus city personal property; and <br />WHEREAS, under said Section 955.02, sales of surplus city personal property with a value <br />in excess of $1,000.00 must be approved by City Council; and <br />WHEREAS, further, under said Section 955.02, offers to purchase surplus city personal <br />property with a value which is less than $1,000.00 must be submitted to and be approved by the <br />Boazd of Control prior to sale, thereby making it difficult and complicated for the City to legally <br />dispose of such property through auction; <br />WHEREAS, it is the desire of this Cauncil to amend said Section 955.02, in order to: (1) <br />provide for sales of surplus property with a value less than $1,500.00 to be approved through the <br />Board of Control, rather than City Council; and (2) expressly authorize the disposal of surplus <br />personal property with a value of less than $1,500.00 by auction, with Board of Control approval; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That Section 955.02 of the Streets, Utilities and Public Services Code, entitled <br />"Procedure for Sale," which presently reads as follows: <br />"955.02 PROCEDURE FOR SALE. <br />(a) Upon deternuning that an item of surplus property should be sold, the Director <br />sha11 determine, using available valuation resources, including, for example, blue or <br />red books, the fair market value of the item of property. If the Director determines <br />that the item of property has a fair market value of one thousand dollars ($1,000) <br />or less, then the Director may solicit offers to purchase the property employing any <br />commercially reasonable method for soliciting offers. The Director shall sell the <br />property to the highest offer, and in no event shall the property be sold for less
