ensuing whereas clauses which follow), which allowed for an increase in the annual average and daily <br />maximum flows from the Service Area to be transported and treated by the Sanitary Sewer System; <br />and <br />WHEREAS, during the period 1992 through 1994, the City borrowed monies to construct <br />certain major wastewater disinfection capital improvements to the North Olmsted Sanitary Sewer <br />System's wastewater treatment plant; and <br />WHEREAS, in 1992, the City bonowed monies to construct a new natural gas main <br />distribution system inside the Sanitary Sewer System's wastewater treatment property; and <br />WHEREAS, in 1994, the City borrowed monies to construct new water, gas and electric <br />services into the Sanitary Sewer System's wastewater treatment plant property; and <br />WHEREAS, during the period 1994 through 1995, the City borrowed monies to construct <br />certain major wet stream, odor control, electrical distribution and process control capital <br />improvements to the Sanitary Sewer System's wastewater treatment plant; and <br />WHEREAS, during the period 1996 through 1997, the City bonowed monies to construct <br />a new East Interceptor Relief Sewer for the Sanitary Sewer; and <br />WHEREAS, the City of North Olmsted and the City of Fairview Park find it necessary and <br />appropriate to authorize their respective Mayors to enter into an agreement amending the Capital <br />Charges Agreement so as to provide for the assessment of additional debt service charges to the <br />Fairview Pazk Service Area relating to the monies borrowed by the City for the aforementioned five <br />capital improvement projects from 1992 to 1997 which benefited the Fairview Park Seivice Area.; and <br />WKEREAS, pursuant to the authority granted in Ordinance No. 2002- _ adopted by the <br />City of North Olmsted Council on , 2002, and pursuant to the authority <br />granted in Ordinance No. 97-17, adopted by the Fairview Park City Council on April 7, 1997, and <br />Ordinance No. 2002- , adopted by the Fairview Park City Council on , 2002, the City <br />of North Olmsted, Ohio, and the City of Fairview Park, Ohio, the Mayors of the City of North <br />Olmsted and City of Fairview Paxk have been authorized and directed to amend the Capital Charges <br />Agreemern so as to provide for the assessmern of additional debt service charges to the Fairview Pazk <br />Service Area relating to the aforementioned five capital improvement projects from 1992 to 1997 <br />which benefited the Fairview Park Service Area; <br />NOW THEREFORE, the parties hereto recognizing and acknowledging the sufficiency of <br />the consideration which supports the following Amendments to the Capital Charges Agreement, and <br />having been duly authorized by their respective legislative authorities to agree to such Amendments, <br />agree to the following Amendments to the Capital Charges Agreement: <br />2.02 Joint Use Facilities Debt <br />page 2 <br />
