<br />4.03 Apaendices I and II <br />Paragraph 4.03 of the Capital Charges Agreement is hereby amended, and, as amended, <br />shall read in its entirety as follows: <br />"4.03 Aopendices I and II. This Capital Agreement includes Appendices I and II hereto, <br />which are as fully a part of this Capital Agreement as if herein set forth in writing, or, if not <br />attached, as if attached." <br />New Appendix II, which sets forth the City of Fairview Park's debt service for the new <br />Joint Use Facilities Debt described in amended Section 2.02, and the Georgette Debt described in <br />Section 2.10, is attached to this First Amendment, and a11 provisions of Appendix II are <br />incorporated by reference herein as if fully rewritten herein. <br />Pavment of June 1. 1997 through June 1. 2002 Debt Service <br />The City of Fairview Paxk acknowledges and agees that, upon the effective date of this <br />Agreement, that is, the date upon which this Agreement has been signed by both the Mayor of <br />North Olmsted and the Mayor of Fairview Park, each having been duly authorized by their <br />respective City Councils to execute the Agreement, the City of Fairview Park shall pay to North <br />Olmsted, in one lump sum payment, the total of a11 of the debt service payments of Fairview Park <br />for the new Joint Use Facilities Debt and the Georgette Debt, as set forth in Appendix II, for the <br />period June 1, 1997, through June 1, 2002. <br />Full Force and Effect Acknowledsment <br />The parties hereto finally agree and acknowledge that, except for those provisions of the <br />Capital Charges Agreement which have been expressly amended by this Agreement or are <br />inconsistent and in conflict with new provisions set forth in this Agreement, a11 other provisions of <br />the Capital Charges Agreement shall remain in full force and effect, and sha11 continue to be binding <br />upon the parities. <br />WITNESS our signatures this day of , 2002, at North Olmsted, Ohio. <br />CITY OF NORTH OLMSTED, OHIO <br />By: <br />page 5 <br />Norman T.
