CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2002-91 <br />BY: Mayor Musial. <br />AN ORDINANCE AUTHORIZING THE EXPENDITURE OF SEVENTY-TWO <br />THOUSAND DOLLARS ($72,000.00) TO PURCHASE THE REAL PROPERTY <br />KNOWN AS PERMANENT PARCEL NUMBER 236-12-004, FOR A PORTION OF <br />THE PROPOSED ROADWAYLEADING TO THE FUTURE GCRTA PARK-N-RIDE <br />FACILITY, AND DECLARING AN EMERGENCY. <br />WHEREAS, this Council, on December 3, 2001, adopted Ordinance No. 2001-156, <br />authorizing the appropriation of, inter alia, Permanent Parcel 236-12-004, for a portion of the <br />proposed roadway leading to the future GCRTA Park-N-Ride Facility; and <br />WHEREAS, this Council, on April 16, 2002, authorized the Mayor to enter into an <br />Agreement with GCRTA which, inter alia, provided for GCRTA to reimburse the City for all funds <br />expended in connection with, inter alia, the purchase of Permanent Parcel Number 236-12-004; and <br />WHEREAS, pursuant to Ordinance No. 2001-156, the Director of Law, acting on behalf of <br />the City, commenced an appropriation action in Cuyahoga County Probate Court, known as Citv of <br />North Olmsted v. Crreat Northern Properties, Case No. 2002-ADV-0062091, regarding Permanent <br />Parcel No. 236-12-004; and <br />WHEREAS, the Director of Law, acting on behalf of the City, has entered into a proposed <br />settlement agreement with the owner of Permanent Parcel No. 236-12-004, proposing to purchase <br />said property for the sum of $72,000.00; and <br />WKEREAS, upon expending this sum for the purchase of said property, the City will be <br />reimburse by GCRTA; and <br />R'HEREAS, it is the desire of this Council to authorize the expenditure of $72,000.00 for the <br />purchase of Permanent Parcel No. 236-12-004; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COIINCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That this Council hereby authorizes the expenditure of $72,000.00 for the <br />purchase of the real property known as Permanent Parcel No 236-12-004, and directs and authorizes <br />the Director of Law and the Director of Finance to take all steps reasonable and necessary to <br />complete the acquisition of this real property and transmit payment to the owner.
