CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2002 - 93 <br />BY.• MAYOR NORMAN T. MIISIAL <br />AN ORDINANCE AMENDING THE TRAFFIC CONTROL <br />FILE OF THE CITY OF NORTH OLMSTED TO PROVIDE <br />FOR THE INSTALLATION OF A TRAFFIC SIGNAL SYSTEM <br />AT THE INTERSECTION OF BROOKPARK ROAD <br />EXTENSION AND SPARKY LANE AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, Warrant No. 11, Peak Hour Volume, has been met at the intersection <br />of Brookpark Road Eartension and Sparky Lane; and <br />WHEREAS, Council and Administration have determined that it is in the best <br />interest of public safety to install a traffic signal system at the intersection Brookpark <br />Road Extension and Spazky Lane; and <br />WHEREAS, it is the desire of this Council and Administration to amend the <br />Traffic Control File to provide for the installation of said traffic control signal systems; and <br />WHEREAS, Chapter 305 of the Traffic Code provides for the maintenance of a <br />Traffic Control File, which said File can be amended only by ordinance. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That the Police Department be and it is hereby authorized and directed <br />to amend the Traffic Control File of the City of North Olmsted to indicate therein the <br />installation of a traffic signal system as aforesaid, since Warrant No. 11, Peak Hour <br />Volume, has been met. <br />SECTION 2: That the Mayor be and he is hereby authorized to have the Department <br />of Public Service accept said tra.ffic signal system to be installed by Tops Market and at <br />their expense in accordance with the terms of this ordinance. <br />SECTION 3: That this ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for <br />the reason that it is immediately necessary to correct a traffic problem that exists at said <br />location, and further provided it receives the af?irmative vote of two-thirds of a11 members <br />of Council, it sha11 take effect and be in force immediately upon its passage and approval <br />by the Mayor.
