CITY OF NORTH OLM5TED <br />ORDINANCE NO. 2002-96 <br />BY: Mayor Musial. <br />AN ORDINANCE AUTHORIZING THE EXPENDITURE OF ONE HUNDRED <br />NINETY THOIISAND DOLLARS ($190,000.00) TO PURCHASE THE REAL <br />PROPERTYg1VOWNASA PORTION OFPERALAIVENT PARCEL NUMBER 236-11- <br />017, FOR A PORTION OF THE PROFOSED ROADWAYLEADING TO THE FUTURE <br />GCRTA PARK-N-RIDE FACILITY, AND DECLARING AN EMERGENCY. <br />WHEREAS, this Council, on December 3, 2001, adopted Ordinance No. 2001-156, <br />authorizing the appropriation of, inter adia, Permanent Parcel 236-11-017 (part), for a portion ofthe <br />proposed roadway leading to the future GCRTA Park-N-Ride Facility; and <br />WHEREAS, this Council, on April 16, 2002, authorized the Mayor to enter into an <br />Agreement with GCRTA which, inter alia, provided for GCRTA to reimburse the City for all funds <br />expended in connection with, inter alia, the purchase of Permanent Parcel Number 236-11-017 <br />(part); and <br />WHEREAS, pursuant to Ordinance No. 2001-156, the Director of Law, acting on behalf of <br />the City, commenced an appropriation action in Cuyahoga County Probate Court, known as City of <br />North Olmsted v. North Olmsted Evangelical Friends Church, Case No. 2002-ADV-0062090, <br />regarding Permanent Parcel No. 236-11-017 (part); and <br />WHEREAS, the Director of Law, acting on behalf of the City, has entered into a proposed <br />settlement agreement with the owner of Permanent Parcel No. 236-11-017, proposing to purchase <br />said property for the sum of $190,000.00; and <br />WHEREAS, upon expending this sum for the purchase of said property, the City will be <br />reimbursed by GCRTA; and <br />WHEREAS, it is the desire of this Council to authorize the expenditure of $190,000.00 for <br />the purchase of a portion of Permanent Parcel No. 236-11-017; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That this Council hereby authorizes the expenditure of $190,000.00 for the <br />purchase of a portion of the real property known as Permanent Parcel No 236-11-017, and directs <br />and authorizes the Director of Law and the Director of Finance to take a11 steps reasonable and <br />necessary to complete the acquisition of this real property and transmit payment to the owner.
