CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2002 - 97 <br />BY: Mayor Musial. <br />AN ORDINANCE AUTHORIZING THE DIRECTOR OF PUBLIC SERVICE <br />TO ADVERTISE FOR BIDS FOR THE NEW NORTH OLMSTED BRANCH <br />LIBRARY SITE DEMOLITION CONTRACT AS DETAILED IN THE PLANS <br />AND SPECIFICATIONS ON FILE IN THE OFFICE OF THE DIRECTOR <br />OF PUBLIC SERVICE, FURTHER AUTHORIZING THE MAYOR TO <br />CONTRACT FOR THE SAME, AND DECLARING AN EMERGENCY. <br />WHEREAS, plans and specifications for site demolition required for the new North <br />Olmsted Branch Library are on file in the office of the Director of Public Service, and <br />WHEREAS, the City's Construction Manager for the said project has prepared an official <br />project schedule for the City and the Cuyahoga County Public Library demonstrating the need to <br />undertake a three-phase site demolition in order that the New North Olmsted Branch Library may <br />be constructed and ready for occupancy by February 1, 2004; and <br />WHEREAS, it is the desire of this Council to authorize the Director of Public Service to <br />advertise for bids for the site demolition and the Mayor, following approval of the Board of <br />Control and the Cuyahoga County Public Library, to enter into an Agreement with the lowest and <br />best bidder; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Director of Public Service be and he is hereby authorized to <br />advertise for bids for the New North Olmsted Branch Library Site Demolition Contract in <br />accordance with the plans and specifications now on file in his office. <br />SECTION 2: That the Mayor, upon approval by the Board of Control and the written <br />concurrence of the Cuyahoga County Public Library, is hereby authorized to enter into a Contract <br />with the lowest and best bidder, in substantially the fonn of the contract which is attached to this <br />Ordinance as Exhibit A. <br />SECTION 3: That this Ordinance is hereby decla.red to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and further for <br />the reason that it is necessary that this Ordinance go into effect immediately so that the timetable <br />for the construction of the new Library not be delayed, and further provided it receives the <br />affirmative vote of two-thirds of all members of Council, it sha11 take effect and be in force <br />immediately upon its passage and approval by the Mayor.
