amount(s) requested exceed the maximum cost of the Contractor's <br />Work approved by the CITY. <br />2.1.7 The CITY shall deduct any and a111iquidated and/or special damages <br />assessed by the CITY under Section 6 Liquidated and Special <br />Damages from the first and any subsequent CONTRACTOR <br />payment requests received by the CITY after CONTRACTOR' S <br />performance of the Work causes the conditions to arise for the <br />assessment of any such damages. <br />2.2 For Work under Section 2.1 Additional Work of the Contractor, the CITY <br />will base any additional costs for any additional services on a total amount negotiated at <br />the time of the authorization of any additional Work by the Board of Control and upon <br />amendment of this Agreement. <br />2.3 For services under Section 2.1 Additional Services of the CONTRACTOR, <br />the CITY shall pay the CONTRACTOR upon receipt of an approved scope and work task <br />breakdown and upon written authorization to proceed with the optional services. <br />2.4 The maximum cost of the CONTRACTOR' S services for all three phases <br />under Section 1. Basic Work of the Contractor is $ which <br />shall be exceeded without an Amendment or without Change Orders to this Agreement <br />duly executed by the CITY and the CONTRACTOR. <br />+ + END OF EXI-IBIT II + + <br />
