? ? <br />2 <br />II. AUTHORITY <br />The Department is responsible for the administration of the Fair Housing Act <br />(42 U.S.C. 3601-3619) and the implementing regulations at 24 CFR Part 100 et seq. <br />The Agency is responsible for the administration and enforcement of the City <br />of North Olmsted Fair Housing Code (CNOFHC) as interpreted, implemented, <br />explained or otherwise effected by Regulation, Rule, Directive, or Formal Opinion of <br />the Chief Legal Officer or the State Attorney General of the jurisdiction. <br />The Assistant Secretary for Fair Housing and Equal Opportunity, in applying <br />the criteria set forth in 24 CFR Part 115.204 and 115.206 has determined that the: <br />fair housing law administered by the Agency provides rights, procedures, <br />remedies, and judicial review for alleged discriminatory housing practices that <br />are substantially equivalent to those provided in the Fair Housing Act; and <br />current practices and past performance of the Agency demonstrate that, in <br />operation, the City provides rights, procedures, remedies and availability of <br />judicial review that are substantially equivalent to those provided in the Fair <br />Housing Act. <br />III. DEFINITIONS <br />As used in this MOU: <br />A. "Agency" or "the City" means the City of North Olmsted, Ohio. <br />B. "Aggrieved person" includes any person who: <br />(1) claims to have been injured by a discriminatory housing <br />practice; or <br />(2) believes that such person will be injured by a discriminatory <br />housing practice that is about to occur.
