BY: Mayor O'Grady <br />AN ORDINANCE AMENDING SECTIONS 949.01 (REMOVAL OF <br />DISEASED TREES 949.03 (CUTTING AND TRIMMING REQUIREDL AND <br />949.99 (PENALTY)) OF CHAPTER 949 OF THE NORTH OLMSTED <br />STREETS, UTILITIES AND PUBLIC SERVICES CODE IN ORDER TO <br />MORE EFFICIENTLY PROVIDE FOR THE REMOVAL OF DEAD, DYING, <br />DISEASED AND/OR FALLEN TREES FROM PRIVATE PROPERTY, AS <br />AMENDED. <br />WHEREAS, from time to time, the City receives complaints regarding dead, dying or <br />fallen trees on private property, which, if left unaddressed, often pose a substantial risk to the <br />health and safety of City residents, and which may become nuisances which can blight both <br />residential neighborhoods and commercial properties; and <br />WHEREAS, the Directors of Public Service and Public Safety, acting upon various <br />complaints received from Council and residents, recommend that Section 949.03 of Chapter 949 <br />of the Codified Ordinances, entitled "Trees and Weeds," be amended so to clearly impose an <br />obligation upon the owners of improved properties in the City to timely remove dead, dying, and <br />fallen trees from their properties so as to minimize risk to the public health and safety; and <br />WHEREAS, this Council believes, based upon the review of this legislation by `,he <br />Environmental Control Committee, that Sections 949.01 and 949.99 of Chapter 949 should <br />also be uudated at this time to properlv urovide for the removal of diseased trees from <br />properties in the City; and <br />WHEREAS, it is accordingly the desire of this Council, acting upon the recommendation <br />of the Directors of Public Service and Public Safety and this Council's committee, to <br />accordingly amend said Sections 949.01, 949.03, and 949.99; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, STATE OF OHIO: <br />SECTION 1: That Sections 949.01 (Removal of Diseased Trees), 949.03 (Cutting and <br />Trimming Required), and 949.99 (Penaltv) of Chapter 949 (Trees and Weeds) of the North <br />Olmsted Streets, Utilities and Public Services Code which presently reads as follows: <br />OF DISEASED <br />or suunoseci to be iniecteci wltri trie liutcn elm «lsease. or <br />
