CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2008 -100 <br />By: Mayor O'Grady <br />AN ORDINANCE AUTHORIZING THE ACCEPTANCE OF A SANITARY <br />SEWER EASEMENT FOR NORTH OLMSTED TOWNE CENTER AND AS <br />FURTHER DESCRIBED BY UTILITY DEDICATION PLAT, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, Norcar Company LLC, operating as North Olmsted Towne Center has <br />offered to the City of North Olmsted a sanitary sewer easement shown connecting Westview <br />Drive Right-of-Way to Brookpark Road Right-of-Way and that also shares other utilities within; <br />and <br />WHEREAS, this Council desires to obtain from said owner a permanent easement for <br />sanitary sewer and utility purposes to locate and install now, and in the future, a sanitary sewer <br />on said property; <br />WHEREAS, it is the desire of this Council, upon the advice and recommendation of the <br />City Engineer, to accept this Easement and to provide for the recording of such conveyance; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor is hereby authorized to accept, on behalf of the City of <br />North Olmsted, a sanitary sewer easement from Norcar Company LLC for North Olmsted Towne <br />Center, the owner of certain real property as further described within the Standard Easement <br />form, marked as Exhibit A attached hereto and incorporated herein by reference. <br />SECTION 2: That the Engineer of the City of North Olmsted is hereby directed to <br />cause said easement to be recorded in the Office of the Cuyahoga County Recorder. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and further <br />for the reason that it is necessary that this Ordinance go into effect immediately to coordinate <br />prompt filing with the Utility Dedication Plat in the Office of the County Recorder; and fui:iier <br />provided it receives the affirmative vote of two-thirds of all members of Council, it shall take <br />effect and be in force immediately upon its passage and approval by the Mayor.
